another bailiff company gets a bashing in court !!!!

The company i am about to write about has had a lot of publicity in my other threads. Here i just give you a positive a-z of what has happened so far. Remeber this has happened with me today could happen to you anytime. The company is jbw enforcement ltd. In 2004 their bailiff turned up trying to collect various warrants(parking fines) The cars were not mine(another story) Paid them off and also complained to no avail. In september 2006 i sent them a sar(subject access request) Along with a cheque for £10. Bearing in mind that i paid a total of 29 tickets and the following is what i paid £5231.00 for pcns that worked out @ £95 each total = 2755. Is what they should have collect plus a 3 warrant fees. they took the above plus a v reg skoda octavia. Now after i sent them my subject access request i recieved the following correspondance link here :

This shows that they only ever had 1 pcn for me which was returned in july 06. Fine but what about the 29 they previously collected ?

iafter several correspondances in november 06 a bailiff turned up again for a warrant that had been revokeed in june of 06. link here :

This is the reply i recieved from jbw when i wrote to complain here :

What a complete and utter muck up. Anyway as they would not comply with the sar(statutory access request) i subsequetly issued against them and got a default judgement for £4000.00 at medway county court. link here :

After which when i posted on the internet and also sent a copy of this to the md of jbw. In reply i got one of the most intimidating letters of my life. Link here : http://s134.photobucket.com/albums/q82/bailiffchaser/jbw%20solicitors/

This followed a complaint direct to the practice manager of oury clark.(will post when scanner is working)

The application was to have the judgement setaside.
On 05/02/07 the set side was granted and jbw ere allowed to submit a defence.Now what you may be thinking i am playing at ? Simple If jbw have kept their records as they are supposed to for 6 years they would have the information i have asked for

They lodged their defence on monday the 12th of march 2007. I will as soon as i can post this as well. I would urge everybody who follows this thread to read it and all the links i have given carefully. This way you can make your mind up as to what you think.

    I really hope that you succed in this - it makes a change for the little person to get the boot in. However I do have to say if that letter from the solicitor is the most intimidating letter you have ever recieved - you are in the enviable position of never having recieved one from a debt collection agency!

    Why on earth were they allowed to get the judgement set aside if they didn't put a defence in in the right time frames??

    Their md mr jamie barry waller told the court that the address the summons were sent to was where they had moved from even though thats where they have been since last year. The court believed him as well. I am currently waiting for the transcript of the hearing and will post the whole thing on here in the next week or so.

    Welcome to the boards BAILIFFCHASER . It will be nice to have a fresh opinion on their practises. I think most of them watch to many episodes of U.S bounty hunters.
    You can always get more with a kind word and a 2-by-4 than with just a kind word.
  • It is straight forward when you want to do the dirty on these
    people. You need to issue a claim against them as soon as you get an oppurtunity to do so. Then watch when they come up with excuses. Watch beat the bailiff programme mon weds and fri mornings on bbc1 9.15 and watch mr waller appear on it. He gets £1k per episode to appear on it.

  • Right what they are saying in their draft defence is that i did this and i did that. Now what they are saying in their 2nd defence is that they have never recieved the sar and therefore do not have a case to answer. What a load of cobblers. Application to strike the defence out i think.
