  • Oh pants. I just discovered this afternoon that in-floor are no more.

    We bought £1,500 worth of flooring from them last September to be delivered when the rooms were finished. Delays and more delays meant that we had a third delivered in April with the rest held for later. Nothing in writing though.

    I spoke to the original administrators who said "it's a pity the directors didn't contact you so you could have taken your goods" which was a fat lot of help.

    Rather annoyingly I used my Visa Debit card to pay the amount in full so I called the Retailer disputes department of my issuing bank (RBS) to be told that the for liquidations the Visa rules are 120 days from the date of purchase. After that "take legal advice".

    So, is that it? Does anyone know if that's correct? Has RBS interpretted the rules correctly?

    120 days from date of debit is correct.
    Unless you have something in writting stating that delivery will be XX date. And that date is within 120 days of now.
    Also you would need something to breakdown the cost to show what you recieved against what you are still owed. As this will be a partial chargeback.

    But any chargeback has to be actioned within 120 days. So if you had something in writting that stated delivery would be after 13/08/12.
    Given in this case you would have to fill some paperwork in. You would have to act fast and be able to fax anything back straight away.

    So any emails you may have sent to them? Asking for delivery to be held to after xx date may help your cause.

  • The only thing I have is "store 8-12 weeks" under "other information" on the original invoice, but nothing to state "delivery after ...". And no emails, I just called them up to arrange the first delivery, and when I said the rest "in a couple of months" they just said ok.

    So sadly you have no claim then. Sorry.

    Although it maybe worth going back to RBS with that invoice and ask if they will try a chargeback. Just make them aware that if it fails you understand you will be redebited again. Given that they are no longer trading it may just work.
    If the rep says No. Ask to speak to the supervisor/tech rep and do a bit of pleading on a good will basis.
    Its one of them cases. Where I love to say.... Nothing ventured. Nothing gained.
