As for the Don, I wish him well, but even he knows that his actions must be 'reasonable' and there is no price guarantee on any tariff. A 3.5% increase in not oppressive, and his Small Claims action will not set any precedent - he needs the High Court for that.
Not quite true. Small Claims Court will set a precedent for any similar cases with similar claims based upon the same or near-identical Terms (i.e. other Three customers in the same position).
It won't be able to rule on the interpretation of terms such as "material detriment" as applied to other contracts.0 -
On the iphone contract, in section 10.1.d it only says "detrimental". I really hope he wins, it could help a lot of us out.
