I got one of these tickets in a Lidl carpark. I just ignored all correspondance and they gave up after about the third or fourth letter. It is totally unenforcable but by replying you are indicating to them that there is a chance that they may be able to bleed some money out of you.0

yes to company and yes to civil regulations, have not read up on them yet. would be quite happy to go to court to be honest, it was 5 yrs and I have the original receipt and statement from the shop mgr to say he asked them to drop it..maybe could get some decent costs off of them that would make a change.
really hacks me off though have better things to do than deal with these **ck heads
Actually you could. Get some money off them.
You say you have the original receipt AND a statement (in writing?) from the shop manager telling their agent to drop it?
You would almost certainly win in Small Claims if you filed a claim (after warning the PPC with a letter before action). You could claim for a few hundred in damages for the harassment and you'd win IMHO, and you'd get your Court fee back and interest at 8% if you claim it as well...5 YEARS ago you say? That's a heck of a lot of interest at 8% per year...
If you want to try then post for help on how to word your claim on pepipoo, see link below. Make your post clear that you need help to word your particulars of claim and explain that you have a pretty good case for harassment otherwise all the posters will just tell you to ignore it. Nothing wrong with that advice normally but you've decided you wish to fightback so make that clear in your post:

In your shoes I would do it. A poster here got about £900 a few years ago for similar harassment from a PPC's debt collector (make sure you name both the PPC and their debt collector in the claim as jointly liable, and issue both with a letter before action first so you can show the judge you followed the Court protocol). In this case you could also name the shop management as jointly liable as well because they failed to stop their agent (but only if the PPC is instructed by them - if not then the 3rd party named would be whoever did contract the PPC). You can't name several defendants on MoneyClaim Online so you would just need to roll up at your local County Court building and collect the right forms for a Small Claim and do it by post.
