Private parking - unbelieveable

This is a good one.
Store car park for customers use only..in central Oxford.
in 2007 got a demand for a parking ticket payment..never had a ticket on my car...sent them a copy of the receipt to prove I had used the shop....nothing heard from them until this yr yes 2012 almost 5 yrs later demanding payment..
Sent them the invoice copy again via email they said it never arrived, then said the appeal had failed 5 yrs ago, and I said they had not informed me...answer its up to you to check..
asked me to pay over phone and they could offer a discount....answer no.
said ok will take you to court...my answer - fair enough
got other letters demaing payment and if didn't pay would register claim at a court. they have said I went somewhere else apart from the shop which I didnt, in 2007 I wrote the details down so I would not forget.
I asked why they waited 5 yrs they said to give me chance to pay...:rotfl:hoping I didnt have the receipt more like and hastle me into paying...which I won't. Also as the purchase was for my business I have the receipt...going to speak to store manager tonight...If you are in oxford beware of parking in the staples car park.
CAB advise I send company a letter again with the copy of the receipt in it, its their work against mine as to if I went else where which I didnt it was raining and after 5pm nowhere in that area to go especially with a toddler in tow. People like these make me so mad making money out of malice they are fully aware of what they are doing.
Anyone else had this sort of thing ?

That must be a record! Our advice would be to ignore them from now on. You have already provided proof so there is no need to do it again. Let them take the initiative and if they do take you to court they will lose."You should know not to believe everything in media & polls by now !"

They WON'T ever go to court (they never do).
It's simply a pathetic business model that these scammers (sorry Parking Enforcement Agencies) use.
You owe NOTHING, they know that, the appeal process didn't happen, it never exists.
They are trying to get you to pay an invoice for a contract you never entered into (nor agreed to it's terms).
Ignoring them once you have sent the proof is the ONLY option. More letters will follow but it's just lies, ignore ignore ignore.0 -

They are all or have been suspended from accessing the DVLA database for gross misconduct!

Who is the parking company? I'd be stunned if they hadn't phoenixed in the last five years anyway.
1. Their charges are unenforceable - they constitute contract penalties, completely unenforceable under English Contract Law.
2. A recent ruling in the upper tribunal means that unless they have proprietary interest in the land, then they cannot enforce their (albeit unenforceable) charges.
3. They'll lose in court very very badly indeed.
Why not write back and tell them that the debt is denied, will be strongly defended in court, and that any further correspondence from them, other than to tell you that the ticket is now cancelled, will be treated as harassment and you will be submitting a claim for harassment against both them and Staples, who you will hold jointly and severally liable. Reference them to Ferguson v British Gas.
If they bother you again after that, then take out an MCOL claim against them and Staples for a few hundred quid, you'll probably win.Je Suis Cecil.0 -
The CAB advice is always rubbish about fake PCNs like this one. They always take the stance that there 'may be a contract' and that 'you would best to write and appeal'.
Absolute boollllocks advice - probably because it was actually written for the CAB by...the private parking companies (really, it was)!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Its VP Parking or as securit there is a link on this site for it but it wont let me add it, if you ring them they answer as securit..
Cab were a bit crap to be honest..didnt even give me the advice they have on their site..
If they are daft enough to take me to court I will make sure I get good compensation from them loss of a days work etc..and I earn quite a bit per day (on a good contract anyway)0
