I think Bargepole is merely reporting what actually happens rather than suggesting it's right. Me, I am still lobbying the Department of Transport to lift their ridiculous ban on parking in the right hand lanes of motorways.

Avoid court appearances by driving at, or below, whatever the speed limit is for the road you are on.

Good advice, and advice that I follow. However, I still received a NIP for speeding, and because I didn't wish to accept the COFP, I got a summons.

So, you see, your advice is not entirely foolproof.

I could have accepted the COFP and handed over a quarter of my licence, I suppose.

    As I said earlier, surreal.

Thank you so much for your contribution, I'm sure this advice will be invaluable to the OP.

I'll bet you're one of those people who drive in the middle lane of the motorway at 65mph in your Rover 416, wearing your stringback driving gloves, hat and pipe, while normal people whizz by on both sides glaring at you while you stare self-righteously straight ahead.

The OP asked for advice on a prosecution, I responded by advising how to avoid one in the first place.

If you see that as pathetic then that says more about your driving ability and your input.

You reinforce this by your mistaken belief that 'normal' people undertake on a motorway.

    You couldn't make it up.

It's simply that your advice is completely useless once the prosecution has taken place. That was what the OP asked for advice on. So, other than being sanctimonious, you haven't helped.

As I say, here we do not tell people off and say it's all your own fault, we try to help.

Here we take Martin's dictum of Help- not Judgment- somewhat more seriously.

I think I know what Martin's dictum is, almost 6 years before you did sunshine.

Martin does not and would not condone breaking the law and/or seek excuses for doing so.

35 in a 30 zone is an offence, absolute, no excuses.

    The law judges, not me.

The OP asked for advice. Don't speed, simple as.

Why would your advice be more valid than that?

    Rubbish.

If anything, a prosecution would hopefully encourage the offender to take my advice seriously, don't speed in the first place.

This prosection isn't the end of the matter. As it is a totting up system, and the offence is not an outright ban, it acts as a warning to improve driving skills.

Top, and most basic, is don't speed.

    How is that useless advice?

So then. If someone comes on here seeking advice about a parking ticket, all I need to say is "Easy- don't park" ?

We are not enquiring into the rights/wrongs of exceeding the speed limit. We are dealing with the problems put in front of us.

Without being judgmental. The OP accepts that the acts were wrong. They do not need people stating the bleedin' obvious.:rotfl:

    +1

The OP asked for advice to deal with the situation their OH found themselves in not advice on how to deal with how the situation arose. One would hardly advise a drowning man not go into a swimming pool if he couldn't swim and had been pushed in. We do not know what the circumstances of the allegation of excess speed against the OP's OH was and to assume achieves nothing.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
