    Why not just screw the tenant in the way you screw the benefits system and your 'au pair', Miss K?

    She does not practice regularly either as a self-emplyed solicitor or as an employee as a firm, she takes on work from friends/friends-of-friends on an ad hoc basis as usually as a favour. She represents herself regularly in her own court dealings, i.e, she is currently undertaking forfeiture of a lease on a property, and in court with another who hasn't paid any rent for months.... But she isn;t a solicitor as such that the general public can call her up and employ her.

    Why do you feel the need to invade every thread with your negativity and judgemental attitude? My business is none of yours, and for the last time I dont screw anybody. The reason you've not seen me here for a bit is becuase Ive spent 10 days in hospital (not something they usually do for a non-existent illness). I have had to resign from my job, losing me a largw proportion of my income so !!!! off and judge someone else

    The problem is in the wording. Saying "fair wear and tear" is so general. Who decides what is fair wear and tear?

    I think the best thing you could do is buy a cheap second hand sofa and take the money it cost from the depost and GIVE BACK the rest. I fear this is another case of a landlord trying to get out of giving back the due deposit.

    The cigarette smoke smell will come out with a wash of the curtains, scrub of the carpet and having the windows open for a while.

    Also professional people are just as dirty as everyone else you know.

    I bet that 'cheap second hand sofa' costs around £2k rather than £100!!

  • Black saturn - Thanks, however she doesn;t want a cheap mangy sofa in a luxury top-of-the-range apartment that has cost £££££'s to renovate. It would look completely out of sync.

    If someone has not taken their shoes off and have trodden oil/filth through a house, or put dockers in a couch, or not cleaned an oven for a year.... is this just wear and tear? To me wear and tear means, over the course of a few years discolouring, slight marks, something looking older than usual, the odd thing breaking..... not damage caused by complete lack of considersation or respect for items?!? :confused:

    Okay, I'll try and help. I rent a flat in London during the week (own a house that I live in at weekends) and there are loads of clauses in my contract about cleaning windows and being a responsible tenant. I repainted the entire living room when a can of coke exploded in there (cream walls) and replace lightbulbs etc.

    In my honest view, unless you specify everything the tenant should and shouldn't do, which would be a pretty difficult contract to get agreement on, you can't penalise them. Ie, if it says no shoes on the carpets in the contract then you can deduct for cleaning footprints off the carpet. If the tenant doesn't know they can't wear shoes on the carpet/stilettos on the floorboards then you can't penalise them because you'd assumed they wouldn't.

    Does that make sense?

    PS. The tentants have signed and agreed that they are renting a strictly non smoking flat.

    Is there a website that has info on this kind of thing, with exqamples of what wear and tear would be?

    It's not the tenants fault that your mum has expensive tastes. You can get some very good second hand sofas around these days. Try your local Aid and Assist or your local British Heart Foundation shop. They check all their items before they sell them and they fire proof them. They won't take donations of anything with a slight scratch or mark on it.
