    I'm sorry, you're right. I'm just angry. Also when I sold it, it wasn't blocked. I'm very honest and if it were blocked when I tested it out before shipping, I wouldn't have shipped it and would've just refunded the buyer.

    Quick question: If the seller on ebay never responds to the case I've opened, will paypal just eventually refund me for the item? What will I have to do with the phone? Bin it? Send it to paypal? Turn it in to tmobile? thanks

    *update* item has been sent back to me and the ebay seller has now agreed to give me a refund upon its arrival back to him. So I've refunded the Amazon buyer and now will be sending it to the ebay seller when he gives me his address. Not that big of a deal it turned out to be because of Soolin's great advice of calling Amazon customer service rather than emailing.

    Hi guys,

    The ebayer that said I can have a refund is not responding to the case where I've asked for his address. Is he trying to drag out the 45 days I have to get a refund? What can I do if he never tells me where to ship to? Can I eventually escalate with paypal? thanks

    I would phone paypal (assuming that is where the case is opened) and ask them to either provide sellers address or add this issue to the dispute.

    It might be that the seller is on an extended weekend holiday

    Where have you opened the dispute, ebay or Paypal?
    Earlier on you said you'd opened in ebay.
    Keep an eye on the dispute, wherever you opened it & escalate it as soon as you can, stating that the seller hasn't provided return address.
    Make sure you keep the special delivery receipt, if you're told to return it.
    Do you have written proof that it's a stolen phone?

    I've opened it on ebay. Yes I will make sure to send it special delivery. Just waiting on that address.

    I don't have written proof but only what tmobile have told me. Should I also do a checkmend?

    If you have proof that it's stolen I don't know whether ebay will tell you to return it or not.
