Nokia N73 Probs

Hi guys,
I have a Nokia N73 on a 12 Mo Contract with O2.
Since renewing sometime in december I have had 4 of Nokia N73s from O2, each time sending the old one back (within 28days), doing a door to door stop.
I am getting fed up of taking days off work to wait in all day for the phone to arrive. On two of the occasions they messed up and did not order it correctly so I waited in twice and it has not turned up. In all I have had to take 6 days off.
Im getting fed up with it now. The phone itself has lots of software problems. It is also terribly slow and crashes alot.
Where do I stand? I rang on Friday to see if I could swap it in store but since it is an online contract it is "impossible to do a store swap".
I think it is terrible.
I really do not know what to do. I can probably cope with the phone but should not be the case. The last person I spoke to at o2 returns admitted there was problems and alot of phones have been returned.
They did however offer me a 6280 but this a major downgrade as far as I am concerned?
Where do I stand guys?
What can I do?

I would right into O2 regarding the matter, I myseld have had 3 faulty N73 handsets and had to write to vodafone as I bought it online and in the letter said due to having a faulty handset 3 times I wanted to cancel my contract. (I was 5 months into a 18month contract) 2 weeks later I had a phone call and they offered me a new phone which was like you a downgrade which I rejected and they agreed to cancel my contract. I then just got another contract with a phone of my chioce. So I would get a letter sent into them.

don't take a 6280.... although a much better phone, it is a downgrade... i've jsut upgraded 6280->N73
my 73 is dodgy too.... seems to switch off every time my boss calls (no, seriously!) and am about to send it back to '3'0 -

Im in the right mind to go to Leeds and speak to them myself. I know exactly where their office is. Its a big fancy building with "O2" about 100 sq ft in size on the side. Near White Rose Center.
My own problem is the contract is the best I've ever seen :P

If you want to keep that contract then state in the letter or when you visit them that you are unwilling to downgrade phone and if they have to then they will have to upgrade it and keep you on the same contract or you will cancel. I always say the best way to deal with people when asking for this is not in a arrogant or cocky manner or they will just fob you off but if you are nice with them they should be nice with you. They will want to keep you as a customer so should not see any reason why they wont do it. Trust me I have done these things so many times with virgin media its untrue !0

No they never give a direct phone number for the compalints service if you fax them the letter they do usually ring you back that day and will sort it quite quickly but if you do get in a stalemate with them then heres the next people to call and they will deal with it for you but hopefully it wont come to that
The telecommunications ombudsman, Otelo, can review your complaint if O2 haven't been able to sort the situation out after sending them a letter of complaint.
Unless there is a deadlock situation Otelo won't look at cases that are less than 12 weeks old.

I will write a letter tomorrow and fax it to them on Wednesday morning (have wed afternoon off).
One more thing - Can I ask them for all details they have on me? I think they do under the Data Protection Act.
How would I go about this?
