Hit by uninsured driver - need help

    If you havn't got the TP's insurance details, then your insurers should write to them direct stating that you hold them fully liable for the accident as such will be perusing them for your losses. That of course can include car hire costs, insurance excess etc and any other un-insured losses. Your insurers will strongly suggest that they pass the letter to their insurers to deal with.

    You could of course do this yourself which you would have to if you only have TPFT cover. But you may have to escalate this to legal proceedings which you initially will have to pay for.

    Nah, the MIB (on valid cases which this isn't) will pay exactly what a regular insurer would pay.

    As for insurers not paying for future non fault loadings, that's wrong too, I've done it.

    You can get the details yourself, either ask the third party directly, or if you don't want to contact them, then it costs just £4 via askmid:

    Thank you for this I have been wondering if I can find out myself as I have the reg number

    The 3rd party aren't very nice people and only live 12 doors up form us so I don't want to deal with them direct if I can help it as I don't want any trouble as I have to live here

    MIB only pay out where no other insurance is in force.
    If you are fully comprehensive, you are insured for the loss.

    This unnecessarily muddies the water.

    There is other insurance in force - the third party car is insured!

    (Though were the third party totally uninsured and liable, then you can still use MIB irrespective of what cover your own policy provides)

    Remember to keep a diary of all the time you spend on the phone, every letter you write, every stamp you buy. All this forms part of the claim.

    As you will NOT be claiming from your own insurer, you WILL have 1 years NCB.

    You will be claiming directly from their insurer. you will be claiming the value of the car, less what you get paid for it when the scrap man comes to collect it. Syphon the petrol out of it.

    To be honest here the easiest thing to do would be to get more than £400 out of the scumbags and let them buy it. Try for £600 make sure to either add the tax disc value on top of whatever you agree or to ensure they are aware the settlement price does not include the tax that you will be getting a tax refund and make sure you syphon out the petrol.

    The thing to be careful about is not getting rid of the car until you have evidence of the damage costs maybe a few photos would do, written quotes would be better or an engineers report, but both those will cost you money -usually. So you could leave it there until the TP insurer agrees a price, but then you are losing out on a tax refund all that time.

    If you have anywhere offroad then put it off road today and refund the tax now. & declare SORN

    How did you prove what the loading was? and was it just for the first year of renewal or more years?
