Hit by uninsured driver - need help

    A difficult one really. If you go through your own insurance then your own insurance will have a claim on it and your premiums would rise. I would ask the third party to offer more than £400 to buy the car from you and don't make a claim on your own insurance.

  • You have to declare to your insurance btw although you don't have to claim.

  • Make sure you get everything back, so if you have paid your insurance for the year, road tax etc. etc. make sure you claim for these things.

    Insurance is to put you back in the position you were before the idiot, I mean other driver hit you and you should not suffer because of this!

    To give you an idea of insurance settlements, I got paid £800 for my P-reg Golf with 150k miles which was basically a shed with no service history. I wouldn't be accepting less than £1,000, bearing in mind you are doing them a favour.

    Given that you insurance is likely to rise (asccident but not claim) because of this for a number of years then you also need to be pushing that they pay for these additional increases in premiums.

    You have to remember that both the girl and her step dad will be taken to court for these offences as he is equally as liable for failing to check that the driver he was responsible for was not insured so they are both in the brown stuff.

    If you car is not driveable and you need a car arrange for your insurance to hire you one and claim it off the 3rd party.

    £1K cash + the daily cost of a hire car until the £1K is cleared into your bank account + you keep the salvage. If not paid by Friday you go to their insurers.

    The third party don't have insurance and the MIB only pay the minimal costs. The MIB or any insurer will not pay for the increased premiums as a result of the claim.

    I have called the insurance company and they have have put it down for info only. They have basically said there isn't much point claiming as I might get something but only if they can claim through the car owners car insurance (chances are the owners insurance will be void due to letting an uninsured driver take the car)

    Also if I claim I will not get a years no claim bonus and I was hoping on that to bring my insurance down from the £1500 it was this year! They have said my premium may or may not go up due to this as it is classed as as 'not at fault/no claim'

    I have someone coming to look at the car today to tell me if it is fixable if it is I am going to tell them I want the money up front to fix it or I will go though the insurance just to make them suffer.

    In the end I will probably end up trying to get a bit of money together and getting a cheap run about to get me through this year (I will try to get some/all of this from them or again I will make an insurance claim to make them suffer)

    Would you be better off submitting a claim through MIB rather than your own insurance? MIB will pay for the costs of a hire car. They won't suffer if you make a claim through your insurance only you will by having an uninsured driver claim and losing a years NCB this year and every year for the next few years.
