Debt Collectors phoning neighbours.

There is a spate of this going on at present according to various debt forums.

DCA's are using databases like 192.com to search for and then telephone neighbours of "clients" to ask them to stick a note through the debtors door to tell them to contact the DCA.

J2 Solutions, Wescot and Link Financial are all guilty of this tactic which goes against OFT guidelines - not that that seems to bother anyone.

The point is the neighbours are often elderly persons who get intimidated by these types of telephone calls - especially if the DCA puts an amount of "pressure" on them to answer their questions and to contact the debtor.

I personally think this tactic is a major breach of privacy laws and would like to see a campaign on here to stop this tactic from happening.

I'm not condoning people in debt avoiding their creditors - I am condoning the low-life tactics that these - so called - professionals are using.

Good old FV - nothing like posting a bit of misinformation to further the debt avoidance cause of you and your fellow DHUK and DQ 'ers.

Bearing in mind that during these calls no information about the debtors circumstances will be discussed please explain exactly how it contravenes any law ?

Nice try though and over 2 pages of replies before I rained on your parade ;)

If they don't give out any info then they have not broken any privacy/data protection laws. However, if as in one of the cases mentioned above they persistently call people trying to get them to drop letters through the door, this is definitely harassment and as such illegal.

Good old Toostie Roll, getting a smart answer in YET again just to annoy people. The DCAs callling the neighbours is harresment.
    To quote my English Teacher:

  • Unfortunately harrassment is very, very difficult to prove as it is extremely subjective. I speak as one who has had someone sucessfully prosecuted for harrassment and even with significant and undeniable proof (considerably more than I have ever seen demonstrated on these forums) and proof of assault it was very touch and go and the CPS wanted us to drop the case.

Hi FV, I am with you on t subject. I started a thread off the other day about DCAs. There are things that can be done and i am of the belief that a sub board as there are so many folk dealing with these DCAs right now would be a brilliant idea. Tjere could be template letters on there and general advice etc. The fact is some of these DCAs do get it wrong. I was rung all day and evening for a debt i did not even have. And i could prove it as well. Thy threaten over the phone that will take all your belongings, that a mr brown will call round between 9am and 9pm. He must be in a lear jet or someting as he has to be in Devon on the same day as in yorkshire. Busy man !!!!!!!!!!!!! They are scare tactics. And just a little point. The DCAs are buying the debts from banks and other places for a lot less than you think. As little as six pence in the pound depending on the quality and age of the debt. They will then chase you for the whole amount. Sometimes adding on their own charges. One thing i will say is. NEVER EVER speak to them on the phone. Do everything in writing only to them. Anyway. Soap box getting worn out. Need to go and get another fr my next rant. xxxxxxxxxx

As I would expect from a DCA Troll - you haven't read all the posts, I'm not rising to your bait and I suggest others don't as well.

If you had read my post you will see that I happily name Welcome and have evidence by way of a letter of apology. If you have anything of use to post on this matter then please do. Otherwise - please just don't.

If you know Toostie of old you will find he/she has been banned from several Debt forums. It's a bit like the Banks trying to justify the unlawful charges that we are all claiming back - this is a Debt Collector trying to justify the underhand tactics that his/her "industry" use in order to gain his/her commission, fair play to him/her for trying I suppose.
  • Just to chuck in my 2 cents worth, if we all stopped being ashamed of ourselves regarding our debts, this would kill a lot of the power of dcas. This doesnt mean we havnt made mistakes, but let's sort them out, not endlessly apologise!

Im now at the stage that they could park a camper van outside my house with the logo "This woman owes us £XXXXXXXX pounds" and in addition "is a bad mother" and it would not affect my decisions.

Im doing the best I can, why dont they try & help me to do it!
    (& I love my children!)
Proud to be dealing with my debts :j
