  • Thanks for that last post. I may well do that and wait for a few of their letters and then contact Asda head office. I've written a letter to the store manager but not sure whether to send it as he was so unhelpful today.

    When I told the manager that I was refunding the shopping I don't think he actually believed me until I went back to my car to get the food.

    Letters like this are best sent direct to the top, the CEO. Their names, adresses and even e-mail addresses are in the public domain.

    Any lower down, nothing will get done.

    In fairness, ASDA are well aware of the situation. For example, at their out-of-town stores, with no problems of other people parking, they just enforce the disabled and mother & child bays. Even elsewhere, they usually only have an ANPR based time limit (usually a reasonable 2 hours) and maybe a "no return in 2 hours" condition.

    They also know all about the Equality Act (I told them) and we've had reports of signs being changed and PPC attendants starting to check tax discs.
    The acquisition of wealth is no longer the driving force in my life. :)

    In my view the Equality Act makes "disabled" bays on private land pretty much incapable of being enforced. This may be good or bad, depending on your point of view, but I think it is fact. Even if the vehicle is not disabled class does not mean that the driver or a passenger isn't entitled to Equality Act protection. Yes the legislation is probably a mess, but PPCs ignoring it or trying to impose their own terms is illegal, and no court would uphold a ticket based upon an illegal sign.

    The EA basically requires that "reasonable adjustments" are made for disabled people. Fair enough. I bet the legislators never even thought about the possibility of these being misused by able-bodied people.

    There has been a discussion on one of the disabilty boards about this, and peoples' reactions when apparently able-bodied people get out of cars. I've had comments made to myself, when I've taken my mother shopping. The concensus of opinion was that about all a shop can do is to have a member of staff checking things, but even then they're likely to get abuse from everyone for their pains.

    Was just wanting some advice....

    Earlier today i went to do my usual weekly shop at ASDA, was in their less than an hour and spent nearly £100. Went out to my car and noticed a Parking fine had been stuck to my window by TCP for £60. I know that there are signs in ASDA about parking charges, there always has been but ive always assumed that those parking charges are for people using the car park but not actually using the supermarket.

    I put the shopping into the boot and then went back inside Asda to talk to the manager, he really wasnt helpful and just made me even more furious. Anyway, he just basically said that the parking policy has been in force for years. But i and so have my family and friends shopped at this asda for over 10years and have never known anyone either to pay for their parking or to get a parking fine!

    So i calmly told the manager that if he couldn't resolve this then i would go back to my car and get the shopping i had just bought and return everything. He didnt want to do anything so i returned everything...and went straight to Tesco to get my shopping again and i can safely say i wont be using Asda again even if it is that bit cheaper.

    But...i'm still left with a £60 parking fine. What do i do? Just ignore it and keep recieving threatening letters and bailiffs???

    Got the parking charge notice at this Asda lunchtime today. I always shop in the evening so might have been missing the signs then! Wish I had thought of returning all my shoppings! But will not be shopping there again! The charge is for £70 but £40 if paid within 10 days! Trully... well too much compared to my £14 food shopping done in 33 minutes. :mad:

    Read your post and was wondering what happened to yours :(!

    I've recently sent a letter to the CEO of ASDA and sent a letter to NCP telling them the various ways they could go love themselves.

    The only reason I wrote a letter was because the car I was driving belongs to my fiancee and we didn't want letters going to her parents house. The intention was to get them sending me letters instead. As of yet I haven't had a reply.

    If the car is yours and you don't mind getting threatening letters for the next few months then just leave it. Don't appeal, don't pay, don't do ANYTHING. Just ignore it and it WILL go away.

    They can't do ANYTHING to you.

    Nothing happened, we can assure you. It's a mail scam like a series of phishing emails, not a parking ticket however it may look.

    We have so much info on here on this forum to help newbies understand that this is a SCAM and to be ready to ignore the 'scary letters'. Do not read the fake PCN and think for one minute there's an 'appeals procedure' at this moment in time!

    See my signature if you aren't used to forums - just one click from here & you see all current threads here, most of which are about the 'fake PCN' scam'.

    Second from the top, click on 'PPC letters & threats'.

    1. Watch the Watchdog clip on there, and then

    2. scroll down to the pics of your fave PPC's threatograms, then

    3. Play a nice game of snap with each matching templated threatogram, then

    4. If you like legal stuff and want to understand why PPCs are very unlikely to win any small claim now (UKPC have never done Court anyway except when they were taken there by Trading Standards!) read the links on this CAG thread.

    No private parking company (PPC) can actually issue a real fine or penalty on private land, retail car parks etc. Nor can they affect your credit rating nor send a bailiff round without the small matter of winning a Small Claim in Court first! And that won't happen.

    The most that will happen is more junk mail letters that you can ignore, over the coming months (the fake piece of paper impersonating a parking ticket was the first link in the chain of this con). The registered keeper gets the letters, so if that's not you then educate them about this well-known scam and show them the links & info we are giving you here.

    Please read the current forum and also show your family and friends so they also learn about this scam. Spread the word like we do! Just to be clear, we are NOT saying not to pay a fair Pay and Display fee nor do we ever condone selfish parking (in your case I know neither apply anyway).

    We ARE saying that if ever you get a fake PCN just laugh at it - and if you want to be proactive, COMPLAIN IN WRITING to the retailer for allowing this protection racket attempt against paying (ex)customers.

  • Thank you all for the reassurance. I did speak to the attendant asking about the ticket and he only referred me to the instructions at the back of the ticket. Went to Asda customer service who said they can not do anything.

    Would they then be able to identify the driver?
