Mum threatening to make me bankrupt

    It was the same amount she said to me via facebook

    My reply was I do not owe you £5000 and I do not have this much left anyway. It was £4500 before you take off all the kids birthday and xmas presents and all the items you've had from me like my dining table, coffee table, new laminate flooring and laptop. You also had a tv out of my catalogue and refused to pay and said take it off the balance. This was sent to her two weeks ago.

    It could look confusing as there is another text message to her saying how much do I owe you Ill give you half this week which was sent from my sister who owes her money.

    Isnt it the law that once money is put into a persons bank account under these circumstances then the money actually legitimately belongs to them unless there is a prior written and signed agreement that it is a loan and has to be paid back.

    If the OP had all this money in her bank and tried to claim benefits it would have been classed as hers surely.

    OP, are you sure its a legitimate solicitors letter, google the company name and see what comes up.

    a contract does not have to be in writing to be binding, although it obviously helps prove the case that it exists

    Ok, so essentially you have admitted that there is a debt to be repayed. However, you can prove that you have repaid the amount she indicated, so you can say that was all you owed her and you you've paid it back. However, if she starts kicking up saying that you owe her 2x, so to speak, and there is a paper trail showing that you paid her considerably more than x, that could possible show that you felt there was more to repay, so to speak. Have you repaid her a lot more than the amount suggested in the FB/text messages?

    Also, how is it possible for your sister's message to be confused with yours? Was is sent from your FB account?

    No my phone via text message.

    There is no evidence I have repaid anything let alone more than the amount she is pursuing as it was all cash withdraws and she never banked it.

    You need to get some serious legal advice, very quickly.
