The Gift card is not legal tender, refunds for defective goods must be made in legal tender, it matters not how a merchant accepts payment, they must refund in legal tender.
    .

Who said they were defective, legal tender detective?

I think that's next on the list for Apple's product development team - a tablet that makes you a decent brew. By 2015 they're hoping to bring one out that shags you too. Isn't modern technology marvellous?

Where the goods are not defected the shop can provide a credit note, if the gift token is credit then, they could offer the gift token and a credit note.

It seems that every store in Scotland is breaking this law then as Im sure they refund using BOS, RBS or Clydesdale Bank notes which are not legal tender...

    Which law are they breaking?

How was the gift card purchased ?
    4 chickens and a pig ?

The purchase of the gift card is irrelevant, it's a seperate contract! In fact, this transaction may not have even involved op.

In this case op purchased goods with a gift card, ops now restoring the goods to the shop and they are restoring the gift card to op.

You'd probably be able to get a Russian bride cheaper though.

    Might last longer too :D

But if the appeal of the Apple tablet wears off and you decide to bin it, you won't be worried about it taking the house and half of your pension pot.

It was £20 on the giftcard & then £109.99 on my credit card. I don't really care abour the £20 giftcard as long as I get the £109.99 refunded onto my credit card & not onto a giftcard which would mean I would have to spend the money in that store!

Do they have to refund you in the manner that you paid?

    Thanks for all the advice
