    That would be my first move, if push came to shove and it ended up in legalities...to be avoided if poss....then you have paid a decent price for a vehicle to be expected to be of a certain standard, well in my honest opinon anyway.

    Have a read of http://www.adviceguide.org.uk/england/undefined/england/consumer_e/consumer_cars_and_other_vehicles_e/consumer_problems_with_the_car_you_bought_e/the_car_you_bought_is_faulty The dealer sold you the car less than 2 months ago, so you have rights under the SOGA. As the dealer also sold you a warranty, you paid him the money as the agent, and if he forgot to register it, he is liable for that as well, and will have obligations as a financial advisor selling insurance products to cover that. Totally his problem, and nothing to do with you, once you pay him, you're covered, even if he foots the bill. It's up to you if you want to let the dealer have a go at fixing it, I'd see what he suggests, if it's not a repair you will accept, discuss rejecting the car for a refund, that's covered in the link as well. He may not be keen on that option, so look at the timescales involved in rejecting the car, as opposed to how long a satisfactory repair would take. Once you go down the repair route though, it usually substantially decreases your right to reject afterwards.

    Update: Contacted dealer who gave me the correct agreement number for the warranty. Seems to be moving along now.

    I know people say the warranty isnt worth the paper but Id rather try and go down this route as going the other way will involve me paying for the work then trying to claim back in the small claims court. And to be honest Its not something I can afford at the moment.

    Obviously if they say it is "wear and tear" then ill be going down the SOGA route

    Whilst i agree broadly with what Mikey72 is saying, due to the length of time that has passed you may struggle to reject the car.

    Typically you can reject the car within 1-2 weeks for pretty much any reason as you are not deemed legally to have accepted it at that point.

    I think here you are beyond that.

    At the price point you are at, you are well within your rights to ask for a repair - and as Mikey says - its of no consideration to you who will pay for the work (the trader or the warranty company) other than it wont be you.

    Also, whilst you may ask for a repair, refund or replacement car, it is up to the dealer as to which makes most sense for him financially.

    If the warranty company dont pay, then you should return to the dealer.

    It is up to him to make good any repair - just because its not covered by the warranty doesnt mean its not up to him to.

    IF he absolutely refuses - and he'd be foolish to do so - then yes, you would have to go down the route of getting the repair done and reclaiming it.

    I would say that it does sound like linkage though, so fingers crossed its an easy repair either way.

    it probably is
    ive seen this twice now this year
    first car a mint low mileage skoda octavia on a 51 plate
    and an audi a3 on a private plate
    on both occasions it locked the clutch up

    Once again thank you everyone for the replies. My car is a 2006 model so kind of hoping the issue isnt the one you posted above.

    Will await and see how the warranty turns out and obviously if the "wear and tear" issue arrises Ill be straight back onto the phone.

    Clutch isnt locked up by the way.
