Used Car Problems

Hello. I recently purchased a used Volkswagen golf on the 21st of March with the mileage 87058. It now currently has just over 91062. It came with a new MOT and FSH. Allthough the MOT did have some adviseries from tyres close to legal limit and the Nearside Front constant velocity joint gater damaged. We was given a 3 month RAC warranty with the car

Since having the car in all fairness she has been trouble free till now.

I pulled into my drive (thankfully) and the gearbox seemed to make a weird noise. I stopped the car and the only gear I could select was reverse. No other gear. Possible gearbox failure?? Linkage?

I then decided to contact RAC Warranty (and yes I have read some horror stories) and to my surprise I was told that the agreement number I gave them was not registered with them at all. Not even the cars registration was on thier system.

I phoned the dealer who I purchased the car from and after a few phone calls managed to find out that the dealer forgot to send off the correct documents to RAC. I left it a few hours and phoned the dealer back who said it will hopefully be sorted tommorow. Obviously this is all well and good waiting for tommorow but in the mean time I have a car that doesnt work.

Im just after advice really on if I have any rights at all and if anyone could advise me on the best route to take

    I think it would be best to see what the dealer says tomorrow. If it's anything other than sorry, don't accept it, and post back.

    Probably claim it was a private sale if our friend on here is anything to go by.

    Update: Contacted dealer this morning and he asked me to give him more time as he was waiting for someone for RAC to get back in touch with him. Told him he has till 1pm as this was totally unnaceptable. He did try arguing about me not giving him enough time but he has had allmost two months since the warranty policy started to get it activated.
  • Its the dealers problem anyway, you've only had the car 5 minutes.

    I wouldn't be pinning too much hope on the warranty covering whats wrong.

    The dealer should be sorting this out, he should be given the chance to rectify the problem.

    Ok well Ill be contacting him at 1pm. Should I see what he says about the warranty or just inform him due to the car being sold less than 2 months ago I want him to deal with the problem?
  • Quite honestly the standard three month warranty given with a used car is only useful as bog roll, i wouldn't be pinning my hopes on that covering the problem, which is probably wear and tear anyway so not covered under exclusions.

    You've had the car such a short time that any reasonable person would assume the dealer should be expected to put it right, this obviously depends on the price paid, a £7k used car would expect to be of decent serviceable quality, if it was a £1500 jobbie then i doubt he'll be too interested and minor problems should be expected.

    We paid 6000 and its a VW Golf. Yes have heard many stories about RAC warranty but we thought that was our only option and that was the route we chose to take.

    Shall I inform him that as of having the car less than 2 months Its down to him to fix it or investigate it?
  • That would be my first move, if push came to shove and it ended up in legalities...to be avoided if poss....then you have paid a decent price for a vehicle to be expected to be of a certain standard, well in my honest opinon anyway.
