Parcel delivered to wrong address and signed for. What to do?

Hi guys,

A friend of my girlfriend recently purchased an item for her birthday from her Amazon wishlist. It was the new Star Wars Xbox 360 console (around £330). As neither of us are usually in the house, we have the parcels delivered to a company in Manchester (similar to a PO Box) who then ship the items out to us to arrive on days when we are at home. The parcel arrived at the PO Box a few weeks ago and there was a delay in them shipping it out to us. We got on the phone and sorted it and were told it would be here on tuesday the 8th. We were both in all day, it didnt turn up. We were going away on wednesday morning and coming back thursday night so we expected to come home and find a missed delivery note but nothing.

She got back in touch with the PO Box company who checked the tracking number and he informed her that the parcel had apparently been delivered and signed for by a "Mr Larkin" which is neither of us and as far as I know, not the name of any neighbours.

What do we do now?? The guy from the PO Box has contacted parcel force and he is waiting to find out where they actually delivered it to and then what?

Does the person who originally ordered the item put in a claim with amazon? Does the PO Box put in a claim with parcel force? Do we put in a claim with anyone? I just dont know how to approach this one, all I know is we are missing a nice shiny xbox which we were both looking forward to playing with!! :(

No Amazon have nothing to do with this, they fulfilled their contract, they delivered it to your address you nominated (the Manchester company) any solutions would be between yourself and the Po Box Company.

The issue is between you and the company providing the virtual address. Amazon have fulfilled their contract by successfully delivering the goods to the address provided.

You need to check what compensation level was included and read the terms and conditions for the company supplying the address.

Hang on guys, the OP states that the parcel was `delivered'. Your beef is with parcel force as a 1st point of call. My bro in law works for Royal Mail and these kind of mistakes normally result in big trouble for the delivery person so they are taken very seriously. You need to get the tracking number from the PO Box company and ring parcel force yourself, you will soon find out if its all BS if they say there is no such tracking number etc, then your beef is with the PO Box guys.

I cant see Parcel Force making some kind of false `delivery' up just to please the PO Box place, start with them and then work backwards to the PO Box company.

Cheers for the advice. I kind of figured nothing could be done through amazon but really need to figure out whether parcel force are in the wrong or the po box. I'm hoping that its with a neighbour and they forgot to leave a card with us or something, I dont really fancy the idea of losing a 300 quid console.

It makes no sense at all that the seller/courier can decide to deliver to any address of their choice and deem the contract completed. Your contract is with seller and not with the courier. It is up to the seller to send a new items or refund.

Edit: Oops, misread. Amazon did deliver to the address specified by you. Sounds like the PO box company failed there contract with you.

Yes op should contact the courier first (also bear in mind not all couriers will talk to the recipient). But op asked who to put in a claim with.

There were two entirely separate contracts in place.
The first one was between the buyer and Amazon, & this contract was fulfilled correctly as Amazon arranged for the goods to be delivered to the chosen address.

The second contract is the one that has caused a problem, and this has nothing whatsoever to do with the seller (Amazon).
It is the redirection company or the courier that they use that are at fault, and these are the people that should either find the console or refund the £330 that it cost.

You need to re-read the op!

The seller delivered the parcel successfully to the address provided! Once the parcel was at this address successfully the sellers liability ends and contract has been fulfilled.

The company supplying the address forwarded the parcel, it would be them that instruction the courier to collect it as part of the contract with op to supply this service.

The seller does not have to send a replacement or issue a refund - their job is complete!

I think people are getting confused with the different parties involved - seller/ PO box bods/ courier - the OP's issue/ claim is against the PO box bods. The seller has no part in the complaint, and the courier is accountable to the PO box bods not the OP.

My doorbell went at about 7.30 am on a Saturday and Royal Mail stuck a large parcel in my face and demanded my signature. I signed and then when I later looked at the parcel address realised it wasn't for me, right address - wrong name. I rang/emailed RM and they didn't want to know, said they had delivered to right address etc. I had a fair idea who it was for as we had loads of wrongly addressed parcels for this person who seemed to like giving out our address.

I kept it safe for a couple of weeks and again RM turned up early on a Saturday morning with this irate bloke shouting we had his parcel. I offered him copies of emails and said I had rung and no one cared etc.

It stopped him having parcels wrongly addressed :D

Point is though RM didn't care who had parcel providing they had signature.
