Marshall Hoares - Can they say this

Just write - whatever - and state that the term "reasonable" in the eyes of the OFT is what is left to repay debts after reasonable living expenses are taking into account, and such monies left must be shared pro-rata between all creditiors - and NOT what teh creditor deems "reasonable".
Tell them you have provided an SOA to show what is available, and all other creditors have agreed the plan based on pro-rata payments.
Tell then you will continue to send payments as per the plan as a statement of willingness to pay, and if they are unhappy with that they should start such court proceedings as they deem necessary as your more than happy for a judge to make the decision as your not in a position to make an increased offer.
You can also point out that as the offer they have received are reasonable given your SOA, any cost other than interest added to the debt from xx (date of the letter/correspondence) will not be paid unless a court demands it.
Point out your ongoing request to communicate in writing only, but you are willing to enter into reasonable discussions re the debt in line with your SOE and other creditors provided it is in writing by post. Tell them they will be reported to the OFT and (any other bodies that are relevant) should they continue to contact you in any other way but that requested, or continue to demand unreasonable payments given you SOA. Tell them further correspondence NOT by letter will be ignored from this date forward, and any attempt of a "home visit" will be reported to the police and the OFT as harassment.0 -
I've told them that they either accept what I can afford and cease harrassing me or take me to court. I will await their reply!Total Debt: £4610.75

Plainly they have not read http://www.moneysavingexpert.com/news/loans/2012/05/payday-loan-customer-charter-to-launch?utm_source=forum&utm_medium=sidebar&utm_campaign=box
You might start a formal complaint to the OFT, as they are currently investigating payday loans. If you've have not made a mistake, you've made nothing0 -

Billingham
I had trouble with toothfairy, went from £400 to £1354 in a matter of 3 months.
Had the same trouble as you re no direct email address. Horrible threatening voice mails from marshall hoares too.
Negotiated through the online contact form on Marshall Hoares website.
They wanted a repayment plan of £150 a month, I explained that was way beyond my budget.
Accepted £75 a month, and froze interest and charges, wiping off £500 in added fees.
I will be offering a F & F at some point.
Keep going, but most importantly don't let them stress you out, easy to say I know, but they are bullies. Trying to confuse the issue with Toothfary/Speedcredit/LondonTreasury/NDR and marshall hoares which all comes under the CIM Technology umbrella I believe.
There is masses of information regarding this lot on CAG website. You are not alone.0 -
Thank you Uglydebty.
did they ever show up at your house and when did they start calming down their threats?
Thanks for your adviceTotal Debt: £4610.75

Hi Billingahnfan
I have read this thread with interest as I'm in a very similar predicament with TFairy for an original loan of £400. I will let you know how I get on!!
I have set up a DMP with CCCS and have started to receive a barrage of emails, many identical to ones you have posted. I am trying to contact TFairy but my emails bounce back when I reply to theirs. Can I ask, are you using the online Marshall Hoarse contact form for your communications with them?
I feel writing a hard copy will be fruitless and I'mnot 100% of their true address anyway. God how I wish I had never taken this loan !!
Good luck in your endeavours to deal with these awful people0
