Neighbour killed our tree, advise needed.

I do understand this. But i live here, not my LL. He is disgusted as well. He is a good man, maybe slow to do things but he's a good LL.
Writing here i know it is my decision. I can only report trespassing when and if i see it. He also doesn't know where he stands - he paid twice for something and he/we got something else - we all have been lied to. I am just trying to research more about what we/he can do. I've been googling this topic, but all i could find is people looking for ways to kill their neighbour's trees. Have no words about this.

How exactly do you think he's killed the tree? poison, digging the roots etc?
If the tree has gone, then it's gone and the only outcome is to plant afresh. With any luck, and they are hardy anyway, it will come back.
I'm not sure what outcome you want from this as at the end of the day it isn't your tree,sorry not being nasty but stating the obvious. Your LL won't appreciate any trouble with the neighbour as he may then find it hard to sell his property at a later stage. What is it that you want from this? Compensation from the tree surgeon?

I have to support others that say it's not your tree.
And even if you have made "this house my home", it alters nothing, the onus is with the landlord. If you can sway him your way of thinking then sobeit, but he has taken money from your neighbour to do a pruning job via a tree surgeon, I take it the neighbour didn't think he'd got his moneys worth so had them return to "finish the job".
This whole thing is going nowhere, give it a couple of years and the tree will be back, (and probably so will the neighbour). :A:AI like the thanks button, but ,please, an I agree button.

Well, I think first off you need to have a tree surgeon assess if the tree IS dead. If it is, and it falls, it could injure someone in your garden as you say. Now whilst many of the posters are quick to point out that it is not your tree, from what I have read it seems that your LL is fully behind you, but obviously you are more passionate about it because you are the one actually living there.
It was mentioned that your LL agreed to the 2nd lot of work- does he have a copy of any paperwork stating what work would be done? Or even an invoice? It does seem very odd that a company would take on work from a neighbour, unless they fully understood what the actual owner wanted.
I think the only way to proceed is to have the stump removed, and have the LL and the neighnour split the cost if at all possible.
A less sensible option, if you are really annoyed with him pulling a fast one and not agreeing, would be to erect a sign saying no tresspassing or similar which could be clearly seen from his garden. That would probably get any potential buyers visiting his house asking questions- and unveil that there are bad neighbour tensions currently. Neighbour wars are a huge turn off for house buyers!
(Unfortunately sometimes they only get resolved by pettiness. My nan suffered with rap music blasting through her walls for months from neighbours who wouldnt listen. Then she went out and bought a very decent speakers system, lined it up against the wall and garden, and blasted pavirotti and opera at them everytime they did. Opera does not equal good street cred, so they were more willing to compromise after that).0 -
The concrete wall won't stop the roots of the tree damaging the foundations of the house if it is close enough.

I thought i won't write anymore as many of you don't understand where i'm coming from with this tread. Guess only LondonLydia gets it.
yes i am with my child when out but if you have kids you know a phone rings-got to get it, he decides he needs a drink after he has watered the roses with the one already made for him and stuff like this. Plus i can see him from the window, so i am not neglecting him as you may want to imply.
I did not say my neighbour would do something to my child. It's just the thought of him jumping through the fence.
Don't think i need to explain myself and my lifestyle anymore.
As i said - the tree was pruned and trimmed nicely the first time, but neighbour wanted it all gone. I gave access to my home and garden for the work to be done but we were left with the damaged trunk - he removed and carved the bark deeply 15 inches carved ring around the trunk 2 inch deep - it looks like someone started chopping it but got tired and just left it. The deal for the second coming of the tree people was taking the whole tree down this was between my LL and my neighbour.
Ok, its my LL's tree what would have been different then?
So as long as i am a tenant and not homeowner its ok for anyone to come to my garden and damage trees and plants that are in there. Nice.0 -

You said the neighbour had been in your garden on several occasions, was this just connected to the tree? Do you think this will stop now that he thinks the tree is dead?
Can you phone the tree surgeon to see if this is how the tree is being left as you feel it is dangerous for your child?I can't be bothered updating this anymore0 -
Unfortunately if your neighbours proprty is being interfered with by your tree, blocking out light or root damage to his property your neighbour is entitled to claim from you for the damage and to request you trim the tree back so that it is only on your property.
Also he can cut back branches to his borderline without your agreement and return the branches to your property for you to dispose of or your LL, and this is legal!
Check the net and you will find the details of his rights and your obligation or your LL's!
The only time it cant happen is if theres a conservation order on the tree in which case it should have a metal tag on it!Signature removed0 -

I think i answered all questions but not where i felt attacked about this is not my tree.
All communications between my neighbour and LL/ Tree people was by phone, no paper records. I only have the receipt for the first trimming as i passed the payment to the workers. My LL is coming to see the tree and is going to speak with the company that did the job, so we'll wait and see.
Yes my neighbour's been in our garden as the cuts he made on the tree are not accessible from his garden. This was the only reason to come to the garden, he never asked for the tree to be trimmed - he wanted it gone. This is my point - he wanted it all gone. But now he's done the damage he's perfectly fine with leaving it disfigured. The tree surgeon told me the tree will fall, otherwise i will not be concerned.0
