Summons to Court - Daughter 'apparently' not wearing seat belt!!

    Sorry poster, wasn't clear from your earlier posts who had actually been charged. I thought it was you.

    Unfortunately, probably worst thing you could say to a police officer is that you will complain about him, puts them under pressure to try and convict just to cover themselves. Never say you are going to do it, just do it.

    give them FA, i didn't actually use the word 'complain', but explained that i wasn't happy about his decision and that i would be going to the station. My issue was and still does lie with that one PC, the PCSO must have been not much older than 18, poor lad felt quite sorry for him. I did approach him when i was leaving to ask if he had actually seen her without the belt, to which he replied that he 'thought' she didn't have one on. If he had definitely seen that she didn't he would have just said yes he did. When i explained to him that she did actually have one on, he said all he could say was sorry. Does that mean he was actually sure?? His manner was how i would expect an officer to be, not treated like an unfit mother who didn't care if her eldest child was wearing a belt or not. I had my belt on, my 3 year old son had his belt on - if my daughter didn't on setting off on any car journey, she would be told to put it on. The PC spoke to me like i was dirt from the outset!

    Not saying you are wrong to complain, just that tactically it is unwise to suggest it to the officer before he makes the decision on whether to report you... but if that is his way of dealing with the public over trifling issues like this I doubt it will be the first complaint that's been put in against him.

    Thanks :) I do appreciate what you've said, i think he'd made his mind up regardless anyway! Still, i'll be a lot more aware next time should anything like it happen again!

    I would have my day in court with this one, if it ever gets there.

    I'm guessing the photographs were taken on a digital device which stores them with dates to show what your daughter was wearing?

    And as for the contradicting things in the statements, I can't seeing it going to court tbh.

    Thanks azza111, it's what my daughter wants to do - even though we're stressing about it! The photographs were taken on her ipod yeah, all of which i've emailed to myself, all with dates and times. Obviously these were taken before we were stopped, but every picture, other than the one's where she's doing eye close ups of makeup show that she is in fact wearing a seat belt. The ipod will also to be taken as proof that nothing has been changed in regards to date / time!

    I don't think you need to email them to yourself, the pictures ought to be timestamped digitally, right click on any of the pictures and select 'properties'

    Does your car have bleeping and flashing when there's a passenger in the car with an undone seatbelt?

    It's impossible to drive very far without realising a passenger in my car isn't done up, let alone for 40 mins with the constant bleeping, even my handbag on the seat sets mine off.

    It won't prove anything, but it could be another string to your bow in your defence, i.e it's impossible to knowingly drive without a seatbelt done up.

    Yeah they are time stamped anyway, i was going to print them off with the properties to side of each picture - just taking the ipod in case they were to think i'd messed with them.
