Oyster fares - cheaper if I touch in/out of one station and walk to a nearby one

I don't think you're comparing like for like here. The 'fraud' on the BBC program was about a guy that touched in but immediately touched out on the adjacent gate as he walked through. That particular person entered the station and used the tube. The OP above is touching in to an overground station then leaving whilst touching out, no service is being used.

If I'm mistaken about the example then I humbly apologise and grovel for your forgivness ;)

It's not so much the validations that were the problem - it was the intentional fare evasion element. Oyster follows a zonal fare system, the idea is that all zones used during the course of the journey must be paid for. Sometimes, the system gives the passenger the benefit of the doubt on certain routes by charging for less zones than the passenger has actually used. But that's down to the default routing programmed and not a concerted effort to fool the system.

Could it be that the stations in question are on the Zone 1 to 2 border and that's the difference - straight to the Tube is treated as Zone 1 start but Overground to Tube is treated as Zone 2 start, crossing Zone 1 but not alighting there? Which as The Urbanite says; might flag up as an unusual pattern if done regularly. Whether it's considered fraud or the equivalent of split ticketing - I'll be interested to hear.

I wouldn't say so. A fundamental concept of paying a fare is that the entire journey made is covered by that fare. Split ticketing is no exception to that. Here, we're talking about avoiding paying the full fare by fooling the system into charging a fare which uses less zones. No matter how clever the method is, fare evasion is fare evasion.

Just to clarify, it is my understanding that in the OP's scenario, the route from the Overground station avoids Zone 1 whereas the route from the nearby Underground station requires a change in Zone 1.

This doesn't seem to be it. I've just checked the details and both the Overground and Tube stations are Zone 2.

Without knowing the stations it is impossible to say whether this is right or not. I suggest you put in the journeys into the Single Fare Finder to see if it charging correctly and it may give a possible insight in to the route Oyster assumes you take using the two different modes of travel.
Did you really mean to put loose?
Lose: no longer possess, not to retain, unable to find
Loose: not firmly or tightly fixed in place

There are 2 on this list http://en.wikipedia.org/wiki/List_of_stations_in_London_fare_zone_2 that state "also in zone 1", is it one of those.

Yes - but does the tube go into zone 1 en route?

Only 1 overground train goes into zone 1 IIRC and thats at euston so it cant be that.

The route from the Overground avoids Zone 1. Hence, you're charged from Zone 2 out to your destination.

The route from the Underground station requires a change in Zone 1. Hence, you're charged for the zones which you use, which are Zones 1 out to those used through to your destination.
