  • yes told them would not accept £200 as had paid £80 for court proceedings

    Its standard practice! I don't know how the banks can say they don't have details of any claim as they provided you with the information in the first place!

  • thanks for that info they mist think we're stupid even their solicitors have wrote to me so someones telling porkies!!!!
    So what happens next will I recieve a form from the county court and if so how long does the bank have to put in thier defenc e??
  • Hi all I'm a newbie to this forum but I have been following Martin's advice and have gone through MCOL taking Natwest on. I too have just receive their defence letter from Cobbetts with a Request for Further Information and Clarification citing CPR Part 18. Am panicking a bit now but saw on the forum a letter from Pam to use in reply to this. Is this all I need to do? Do I send a copy of my letter to the Court in Northampton cited in Cobbetts letter? Do I need to send anything else to the court. I kep reading about a Court Allocation Questionnaire but I have not received this or anything at all from the court. Just got the letter from Cobbetts yesterday (spent the day panicking) and have until 9th July to reply. please help!!!:confused:

    Just found these posts and will shift them into a thread that will help.

    Basically send off to the solicitors your spreadsheet/list of charges even if you have already done this but you don't need to answer the other questions the solicitor is asking.

    I seem to be in the same boat as few people on this thread. I have received a letter from the solicitors on behalf of a claim with Lloyds TSB asking for all the info again which I sent, now they have put in a defence to my court claim, and from what I gather they are saying similar things such as the claim is too vague, no account specified, no proof showing how I got to the stated claim amount etc. all which the bank has received several times and the solicitor now has.

    However I did not receive a court allocation questionnairre to fill in, and on the Notice of Transfer Proceedings sent from the small claims court, the fact I should fill one in and return to my local court has been crossed out!!!

    I am now wondering what I should do. Do i need to fill one out? will one be sent at a later date? plus there is no indication of a court date.

    any help is appreciated.

    As regarding the AQ you'll find most people are now receiving this letter with it crossed out as the courts try to speed up the process. Your local court will send out a hearing date once this is set.
  • I've gone through the whole procedure.. taken the bank to court through small claims now their sollicitors have written asking for more infromation:
    1 - all the details on the bank charges i've already given them, and 2 - asking for me to "specify all of the facts relied on by the claimant in support of the contentions" (unfair terms in consumer contract regulations 1999, i think they mean...) "and in particular please identify the regulations of the unfair terms in consumer contract regulations 1999 ( 'the regulations') relied upon by the claimant in alleging that the contractual provision(s) referred to are unenforceable.

    now i've printed out the regulations had a quick look through..and dont clue what could be used to cover myself. so martin, if you reading this i could use some help as to the particulars of the regulations...and fast.

    Send the list of charges again and ignore the rest - it is known as intimidation tactic and you do not have to answer these questions. They are only for the judge to ask.
