Letter from bank/solicitor during Moneyclaim online process...

    PLEASE PLEASE HELP URGENTLY
    Yesterday I asked for for help replying to natwest solicitors letter and had one reply which was advised me this letter is normal but nothing was said on how to reply. I can give them info relating to charges but they are asking me to clarify the following:
    (a) Is it the case of the Claimant the same should not have been charged
    (b) If yes please explain why the Claimant contends that the same should not have been charged.
    It then goes on to question (c) and (d) and (e) and its all legal jargon which I don't understand.
    Then there is a section on Consumer Contracts Regulations 1999 which they ask me to specify all of the facts relied on and again I don't know what they are talking about.
    They are saying I have to respond by 19th June can they time specify as I have heard nothing from Court since natwest filed their defence.
  • Sorry if this post gets your hopes up but I wanted to reply since no one else has. I can't help you, my guess is as bad as yours.

    The charges been disproportionate, unfair and in your opinion profiteering from breach of contract.

    As (b) above.

    The facts relied on are:

    The bank has charged you x amount of £'s for charges for exceeding overdraft, unpaid direct debits ...etc, these charges in your opinion disproportionate and are the bank profiteering from a breach of contract ... etc

    The charges for breach of contract are to reflect the losses incurred by the bank and which you are of the opnion they have far exceeded thus profiteering by levying punitive charges upon you.

    As the above posts, send the solicitors the list/spreadsheet of your charges even if you have already send them, use Martin's wording earlier in the thread where he asks why the solicitor doesn't already have the details of the claim!

    As regards the rest, you can ignore this as it is termed as intimidation at this point.

    Hi Vikki,

    I've had the same letter from Cobbetts requesting information and I too are confused!! Did you find any help? because I've looked everywhere and can't see anything.

    I would really appreciate any help or advice.

    i'm in the same boat as you as cobbetts are requesting more info & forcing CRP18 if we don't.
  • I have just received a letter from the Court which states that unless by 11 July the Defendant files an allocation questionnaire the Defendants defence will be struck out and the claimant be at liberty to enter judgement.
    Also, the same day I received a letter from the Banks Solicitors requesting I send them an itemised schedule of the charges claimed as the bank have not forwarded the schedule which I sent them so they can review my claim. The question I would like answered is, is it up to the bank to provide this information to there solicitor or should I send it to them as requested?
    They have also added that they are unable to address my claim without this information.

    Send the information as requested, it may well be up to the bank to give them this but it might speed up your case if you send it again.
  • hi been reading the forum can anyone tell me what i do,next. claiming £585 from yorkshire bank(clydesdale) sent every thing to county court they have put in a defence ,saying dont have details of bank account etc . Had a letter from their solicitor offering £200 before i even took them to court!!!!!.anyway have faxed of all relevant info still have not heard anything back what happens next????:confused:
