Cap one have a good reputation for complaints handling. So, much so that the FOS only overturned 11% of the complaint rejections in the last 6 months of 2011.
This either indicates they have a good documentation audit trail and can support the sale of their products or that they are paying out on most cases and only rejecting suspect complaints.
How's everybody getting on. I got a letter from Cap One today about my credit card PPI.:)
They say they are receiving a high number of PPI complaints and are currently working through a back log as quickly as possible. They will try to provide me with an answer within 8-10 weeks of the letter. They also say they are taking measures to try and speed up the process and reduce the 8-10 week wait time.
So now I am waiting for a similar letter about my loan protection insurance.Debt-Free day 30th September 20140 -

I'm still struggling as don't know what to do for the best now, it's causing me too much stress (looking after my sick mother too) I think I might just take all my paperwork & letter from Cap one to a claims handler & see what they come up with.:(

I also had a Cap1 card in 2004 & PPI payments were added onto the statements each month, it was only after being made redundant in 2007 I got in touch with them to see how I could make a claim. I was asked a lot of questions whether it was voluntary or compulsory etc & when I explained it was officially compulsory due to NHS cutbacks but the NHS had given me a package giving me my pension as I was over 50 & had worked with them for over 10 years that the advisor said as I had received a lump sum I could therefore make my monthly payments or pay off my balance. Maybe so but what was the point in having PPI & paying out all that money each month?
I did pay off my balance eventually but feel I was initially mis sold the policy in the first place.
I sent off the questionnaire in Sept 2011 & they sent me a rejection letter & a copy of my application form where there was a tick in the box (I can't honestly remember doing so) but it does state in the event of sickness & redundancy.
If any one can advice me what to do next I'd be grateful as it's really bugged me over the years at having to pay for something which wasn't needed.
PS I sent exactly the same questionnaire to Barclays re my loan they not only paid me for that loan but went back to old loans from 2001 so well done Barclays.0 -
If you had a rejection in 2011 and did not reply rejecting this, then you have passed the limit to do anything with this claim now as the 6 months are up to go to FOS.
No I didn't reply back as my mother was taken seriously ill,
do you think I could reply now or claim again explaining the circumstances or is what you are saying is I can't do anything about it at all?0 -

Cap one sent hubby a letter after 7 weeks upholding his complaint almost £2000 settlement figurs + guess he was lucky they got his complaint before the high volume of complaints scenario, I'm pleased I rang them to check after not hearing anything 2 weeks after sending his complaitn, I probably still would have been waiting...0 -

If you contact FOS, explain the situation with your mum and ask if they can deal with this, if there are good reasons why you did not go to FOS with this within the time scale, it is possible they will accept the claim.

Calw, well done for being proactive and calling them after 2 weeks to hurry things along and what a great outcome. I went to their website and it said they had 4 weeks to acknowledge PPI complaints. I thought I'd go by the book just in case I needed to go to the FOS.
jdm52, You are in a tricky situation. You don't say what your reasons were for thinking PPI was originally mis-sold although you tried to claim on it when you were made redundant.
Therefore, did you think it was mis-sold because it didn't pay out when you were made redundant?
If they asked you lots of questions at the time you tried to claim does that mean even though you were made redundant you still didn't meet the correct criteria for a payment. Perhaps something was in the terms and conditions that you weren't aware of.
If you think it was originally mis-sold, then it doesn't look good if you tried to claim when made redundant.
I think the redundancy aspect is the stronger part of the case as retrospectively had it been made clear to you what criteria you had to meet in order to get a pay out for redundancy you perhaps wouldn't have bothered.
Also, the advisor has given you an out by effectively saying because you have a lump sum you can pay the debt yourself. However, that redundancy/pension package was for priority living expenses and priority bills/debts and had to be divided by the number of months/years it took you to get any benefits you were entitlted to, or a new job.
As you have missed the deadline to appeal the rejection perhaps follow amersall's advice and tell the FOS that you had extenuating circumstances and also highlight the redundancy aspect of the case.
It is a lot to deal with, with a sick mother. If you can find a good claims company (no win, no fee and no extra charges other than a percentage of the refund if you are successful) and in the event of a refund be happy with what's left after the claims company has taken their cut, then perhaps it is worth it to you. They at least can scour the Ts and Cs and the details of your redundancy package and take the best course of action.Debt-Free day 30th September 20140 -

I hadn't realised I'd got PPI when I first had the card as I said I honestly couldn't remember ticking the box, it was only when going through my finances after been given my redundancy notice that my daughter pointed out that a charge was being made each month ( I have Glaucoma & my eyesight isn't too good) & she suggested giving the company a call, the guy agreed I had it but his arguement was the fact I had the lump sum coming so could pay the balance off, I asked him what was the point of me having PPI then & he couldn't or wouldn't give me an answer. I put this in the comments box on the questionnaire, The rejection letter makes no comment about this just that the policy wasn't mis-sold as I'd ticked the box. I've since mentioned this to a friend who thinks they have misunderstood my reasons for claiming the PPI back & has basically said what you've written,she's going to read the T&C's which they enclosed with a copy of my agreement & rejection letter which was dated 5/10/11 hopefully she can find something which means I don't have to go searching for a reputable claims company.... reading the thread above about claims handlers makes one very wary.

Hi here's a quick update
I spoke to a vey helpful young man at the FOS who has accepted my reasons for the delay, he's given me a reference number & has asked that I send in a letter with any evidence to support my reasons for the delay & complaint.
Now the letter is the easy bit (I think) but what should I send in as evidence? when I asked the question he said whatever I feel is necessary but to include a copy of the rejection letter & too much is better than not enough
