Car Not Fit for Purpose but Dealership Refusing to Refund Our Money?

Therefore you cannot claim the the vehicle is not fit for purpose.
Unfortuntately for you, your beliefs are not supported in law.
So basically you are suggesting that this faulty vehicle is of satisfactory quality? I don't know from your reply if you read the full post but basically the vehicle was sold to us with a leak which was concealed by the dealership and further attempts to rectify the leak and resultant damp by the dealership have been unsuccessful.

- fit for purpose, eg if you ask for a car that can tow a caravan it should be able to

Thanks for your reply Londontiger, I don't trust this car at all now and would rather have it out of our lives. I'm hoping to get our money back but am astonished at the dealerships attempts to rip us off further by charging us £1000 to take the car back by offering us trade in value only.0 -
Probably not any use but I had this type of thing on a car before (not a Ford) and it was a bit of welding the robot had missed and water was getting in there. Took a couple of garages to diagnose it.0

As others have mentioned, the car should still be under the manufacturer's bodywork warranty. I suggest you contact Ford UK about the issue, especially as you bought the car from one of their dealers. Also, it may be an idea to try and find out who the previous owner was. They may be able provide some additional info about the problem.

This could be blocked drains in the bulkhead, they have rubber grommits that block up and the water enters via the heater intake and runs out under the seats.

Please don't take this the wrong way, but I just get feeling that you have fallen out of love with the vehicle and now wanting to use this fault as our ticket to a money back refund. If the original seller fixes the problem you cannot insist on still returning it.
Frankly a car that was broken and fixed under your watch, is far more "trsutworthy" than a new preowned car. At least that's the case for me. You dont have to go through the "hidden surprises" phase with the new car all over again.
Every used car has problems, none of them are headache free, that's partly why the original owner sells them.0 -
Have you asked the garage to replace the 'damaged' carpets?
Even when they are dried out (assuming that the leak is fixed) there will still be a musty smell.
I had a Skoda Fabia VRS that suffered damp rear carpets due to blocked drainage hole in the rear doors, the garage fixed to fault in the doors and replaced all the carpets without me having to ask.0
