Just Want Another Opinion
My daughter phoned me this morning because she had been stopped by the police on the way to work. Apparently their computer had flagged her car as having no insurance or MOT.
Well, she told me where to find her insurance documents and it only took a minute to confirm the policy number and that she is indeed insured. For some reason it was not showing up on the system. As for the MOT, well the car is not 3 years old yet. It was registered on 01/09/2009.
They let her go to work but she phoned me again to say they had phoned her to say that although the car was registered on that date, it was possible it was manufactured 6 months before, maybe sitting in a garage somewhere and that was why the MOT had run out. I was sure that the MOT was due 3 years after the date of registration, not of manufacture. After all if someone bought a new car that had been manufactured in Japan 6 months ago, they would not expect that car to need an MOT after two and a half years.
She was told to check her documents so I had another look for her as she is at work. The car was bought from the main Toyota dealer in December last year (2nd hand) and their schedule states that the MOT is due on 01/09/2012. I have also double checked the registration document. Not sure what else she can do. They have let it go but she is worried her car will be flagged up again.
I have advised her to carry her documents with her for the time being (although if someone broke into the car that would not be such a good thing). I suppose it is Friday the 13th.:)

If a vehicle is registered with no prior use on the road, the MOT will be required three years after the date of registration. For example, a vehicle registered ‘from new’ on 1 April 2004 will require its MOT no later than 1 April 2007.
If a vehicle is used prior to registration, as would be the case with an import, the MOT will be required three years from the end of the year of manufacture. For example a vehicle manufactured at any time in 2004 will require an MOT no later than 31 December 2007. There is no grace period given after these dates.
If the registration document says 01/09/2009, and there is no evidence of it being used beforehand ie. it was registered with delivery miles, it doesn't need an MOT before 01/09/2012.
It doesn't matter when it was manufactured.
Presumably it only had a few miles on the clock when it was registered?0 -
If it was me...
I would take V5, the insurance document that shows she is insured AND the main toyota dealer paperwork that says that the MOT isn't due until 1-9-2012 down to the local Police Station and have them sort it out once and for all.
It'll probably take them about 3-7 days to get their system updated but it'll save your daughter having to carry these valuable documents around with her all the time.
The Police should give you/her a reference number or if not ASK to have something that PROVES what you did to sort this out. PLUS get the name of the person you speak to at the station that way when she gets stopped again she can give them a number or name and hopefully that'll make it OK.
yes it's annoying when they stop innocent people, but more annoying when you are involved in an accident with someone who isn't insured/licenced to drive/driving a death trap!

Could it be that it was registered in Jersey, used and then sold here, I bought a car and thats exactly what happened with mine, there was a six month discrepancy so I had to have it MOTd 6 months before I thought I had to.
Just a thought.
Although that wouldnt really have anything to do with the insurance.make the most of it, we are only here for the weekend.

She did not buy it from new. Only the previous owner would know that but I thought it was a straightforward 3 years after registration. Any idea how we would find out when it was manufactured? I can't see anything on any of her documents. Also, the main dealer has stated on their schedule that the MOT is due 1st September. The V5 will state when it was first registered so as stated above get her to gather the docs together and she can go to her local station to get it sorted out.
There is a chance that the main dealer docs are wrong and that it had been pre registered then sold, but the V5 would show this.
EDIT: A main dealer would be able to tell you when and where it was manufactured based upon the cars chassis number. Depending upon the model it could be the Uk or Europe rather than Japan.0 -
