As the others have said unfortunately this is not an uncommon occurrence. Exactly the same thing has happened to me and I am at present going through the appeals process. How the government cannot see that something is blatantly flawed is beyond me.0

In respect of how the ESA assessment relates to mental health issues only!
On that topic, I would agree that the assessment does not work well.
But that does not mean to say that on the whole there is a problem with the assessment procedure, relating to every other illness and condition.
The main problem with the assessment is the lack of time allowed for the assessment to be carried out, and the almost, total reliance on the computer software.
The assessors are well within their rights to add manually to the report, comments etc. They are expected to justify every decision and comment they make that is in contradiction to what the claimant says.
Time is against them. They should be encouraged to take as long as necessary and should be actively encouraged to write the report where the software disagrees.0 -
I do agree with fb. ATOS are paid according to how many people they see, there is no incentive for their employees to take as long as needed to get things right.0

in my medical i was too honest with the answers to the questions and thats why i failed, you must give the answers for your worst possible day not if you have 1 half decent one out of 7,as for my report i agree with some of the comments made, i had a total loss off feeling in one of my fingers the nurse advised me this could be serious which made me really worried and advised me to seek medical attention as soon as possible,so what did i do went straight to hospital got admitted and got checked over only 30 mins after the medical,was this mentioned in the report no not a thing these medicals give evidence to the decision maker etc it is vital atos record everything down and nothing is rushed not just for the patient but to stop themselves getting embarassed as well that totally undermined my medical and the appeal board asked why was it not on the report ?No Links in signatures by site rules - MSE Forum Team 20

I was reading an atricle in a local paper the other day, and from what I read, it seems like it's not just ATOS that like to fabricate their findings.
the guy in the article went to an appeal and was turned down. when he got the statement of reasons, one of the things supposedly written in it was that the panel had observed the man in question taking his hearing aid out of his top pocket, turn it on, then put it into his ear before the hearing actually started, thus proving he had no manual dexterity problems.
that would be all fine and good, apart from him claiming he wasn't deaf and didn't even own an hearing aid.
the more I hear about the whole system, the more I can't help but think it's not on the level.0 -
The HCP's at ATOS are liars, in my report he stated that i had extremly large well defined muscles with no sign of wastage, thats a laugh. hes said i took my coat off and put it back on no problem, i wasnt wearing one plus i had my arm in a sling.

My dd was refused ESA because ATOS decided that her asthma was not bad enough for her to refuse to work. She does not have asthma, never said she had asthma and has never had the condition mentioned by any of the specalists she sees. In fact, the only people to mention asthma are ATOS, who said at her medical "so, this condition you have---its like asthma" It was not a question she was asked, rather it was stated as a matter of fact.
She (with help) appealed.
She went from being refused ESA and being told to get a job to being placed on the support group.
I think the amount of money being wasted by the government in using ATOS must be staggering. I am sure that at the start many people were put off from contesting the ATOS "decision" but now I feel that most people appeal as a matter of inevitability. The problem is that nobody outside the system really knows what is going on and trust the government to appoint a company that knows what it is doing. Unless of course, ATOS is doing exactly what they were told to do.LBM-2003ish

Advising people to report their worst days only is extremely poor advice.
It can result in prosecution and imprisonment at the worst, 'just' having to repay your benefit, and finding further applications almost impossible if not.
If, for example, you do not say you can walk 100m occasionally - if someone from the DWP sees you doing this - you risk prosecution.0
