ATOS are nothing but liars

Was reading through my fathers assessment from ATOS, she has plain lied in most of it, for example she said he was able to 'hold door open on his way to assessment room' 1. she led us (how the hell did we know where it was) 2. I was with him and HE DIDN'T OPEN ANY DOOR.
She also put in the report that he ONLY visits his GP and doesnt attend any specialists.
LIES - he attends a specialist for his condition regularly at the Hospital, he told her this but yet she lied on the report.
The whole report was a joke, the 'Doctor' put words in his mouth, he got confused but she wouldnt let me speak, she tooks things out of context to suit the descision against him.
SO WRONG!, Sorry but Im just so angry, lets hope the appeal people are more understanding.

The question you should be asking is did your father touch the door? If he did, it could be said that he 'held it open'. It's little things like that that ATOS pick up on.
You could argue that it is natural instinct to 'touch' the door just in case it closed in his face.
Just watch the general public at a door way, many if not all, in going through the doorway would touch the door as they pass through.

This was probably a misunderstanding on either part.
Simply rectified by sending in copies of the outpatient appointment letters and copies of the letters sent to the GP.

I am the last person that would defend ATOS, but the assessor is a cross between a detective, an IT operative, and someone that understands human behaviour.
They aren't going to be nice and they will put people under pressure. It's the nature of the exercise.
Your father should have been 'prepped' as to what to expect and how to deal with confrontational questioning.
Is it the fault of ATOS that your father was not able to
fend off the line and way of questioning. That is why people go with someone to ensure that the right answers are recorded and that that the assessor does not overstep their mark. Much the same as you would take your solicitor in with you when being questioned by a police officer.

All you have to do now is to provide evidence before the reconsideration that all of the disputed statements your dad was supposed to have said are just that - rubbish!0 -

ESA is the first benefit he has claimed - he worked all his days and we were not aware this so called assessment was going to be so sly and manipulative. We had no idea how the system works until now. I just hope the appeal tribunal arent like this in 2 weeks time.0 -

Personalising it, and calling people liars does generally not help.
It is very unlikely the assessor was actively lying.
Are there inaccuracies caused by the assessment software, and insufficient care taken on the assessments - certainly at times.
It is important to work out the difference between inaccuracies in the report which upset you, and inaccuracies in the report which make a significant difference to anyone reading it attempting determine his ability as regarding the descriptors.
http://www.dwp.gov.uk/docs/m-06-11.pdf - this document lists the specific descriptors.
If, for example, his ability to hold a door open is not in question, then that would have little relevance to the outcome, though may raise issues about the quality of the assessment.0 -
@doyouwantfrieswiththat - Yes you are right, the SO called medical assessors are full of lies and will make up anything so that when your fathers files goes to the SO called decision makers they will straight award him NIL points and kick him straight off ESA and you do right to appeal because again, you are right about ATOS, its a joke and a scam!!
As far as im concerned and i dont care what other people have to say but in my eyes the SO called medical assessors are breaking the law by committing perjury and perverting the course of justice because they know full well that your father would appeal against there decision and KNOWING full well that the assessment would be used in a court of law (Her Majesty's Courts & Tribunals) and deliberately LEING when you can prove otherwise then like i say, to me, its perjury and perverting the course of justice and i would seek legal advice on this and also i would go as far as emailing the courts of human rights because once they kick you father off ESA they will say he is fit for work and i would use article 3 or your human rights, yes ok nothing will happen but if the human rights courts received a lot of complaints RE this type of medical then maybe in time something could happen because its just getting worse and yes, i am angry because of what they did to my friend last year. i wont go into detail but it were disgusting but she is no longer her now to defend herself.!!
Oh and i would advise anyone going to one of these medical assements to take some kind of recording device, IE phone and put it on record the minute you go in the integration room?0 -
Just out of curiosity does anyone know if ATOS staff have targets they have to meet or are they truly independent?Dum Spiro Spero0

I think ATOS staff are paid per assessment, so the temptation will be to get through as many as they can, rather than taking time to do the job properly.
basa2000, you can now get the assessment officially recorded, the claimant is given a copy of the CD before leaving the building.0 -

Two weeks???
Did you not try fighting the case at reconsideration stage with sufficient evidence to disprove the relevant comments?
I do hope that you have a case ready to argue in court and that you have sent copies of your evidence to the court?0 -

we were told he had failed, were asked if we wanted to appeal sent of GL24 and all possible medical records/reports.0 -
nothing unusual the report we got back was exactly the opposite of what was said and the reality of the situation - took a year for it to be sorted out - may as well not have been there for all the notice they took of what was said in reply to questions.
They have agreed to the next one being recorded so somewhat naively I am am remotely optimistic they will accurately record the answers as given and not make it up.
But prepared for it being the same scenario and having the go through the appeal system again, least this time I can expedite things giving the lies we were fed last time so know what to expect and what needs to be done.I am responsible me, myself and I alone I am not the keeper others thoughts and words.0 -
just read through the indicators document, and am at the conclusion the drs selected need further training as looking at what is basically a multiple choice that they have to compare answers of those attending there seems to be a translation issue here as they often seem to go for none of the above giving a 0 score, when the answers quite clearly would fit perfectly other selections,
