If so then hopefully she can invoke point 3.2

I have just called them to cancel my subscriptions (yes, I fell for this against my better judgement). I was told that clause 3.2 only relates to the US site or one-off purchases; not the 'membership' program I inadvertently signed up to on my 'free trial'. Good news is that I persuaded the agent to refund the last shipment and they told me not to bother sending the pills back. We will see if this actually happens.
I was quite annoyed to see some comments on here basically blaming the 'stupidity' of the consumer for not reading the T&Cs. Yes, you are of course correct but let's be honest here, that is a cheap cop-out when actually, the companies running these kinds of subscriptions purposefully set out to mislead us. With so many online transactions going on in our daily lives, it simply is not feasible to read the T&Cs for every service (free or paid for) that we subscribe to. Google and Apple's T&C are endless not to mention the fact that you are assuming that everyone who uses the internet is educated and literate enough to understand what they read.
I think that comments like this are not helpful or constructive - just plain patronising.
Rather than blaming naive consumers, there should be more emphasis here on rogue traders such as these guys who prey on people with very severe issues when it comes to self esteem and their perception of their weight. They make some very bold claims about the effectiveness of their pills and I can totally see that people who have struggled to control their weight for years would only hear the powerful sales message which makes them instantly dismissive of the potential risks or legitimacy of the claims.
Is it too much to ask that we are advertised at and sold to in a responsible, honest and transparent way or are we expecting society to be proficient at cutting through all the BS on the internet? If so, then I suggest this should be taught in schools from a young age as actually, assuming that everyone knows of such scams and how to identify them is more naive that signing up for a free trial for some diet pills. :A0 -

I called on Monday and was also on hold for a long time. You should be patient and you will eventually get through.
I also recommend taking a polite but firm position with them as this is the most likely way for you to get a positive result. Tempting as it might be, ranting or trading insults will not get you anywhere with these guys.
With regards to the refund, they will claim that this clause does not apply to people who signed up to the lifetime membership program! I got round this by quoting the clause that someone else posted earlier in this thread and stating that they are under legal obligation to share terms before any contract or agreement is entered in to. They accepted this and refunded my money no problem.

I also fell for this, and yes I know all about "buyer beware" etc. and I feel particularly stupid! So having said all of that I still believe that when the T&C say that you can cancel at any time you should be able to. I emailed them and tried to call. Every time I emailed I had the repsonse that I needed to cancel by phone. So I have sat on the end of the phone for what seems like hours, and eventually they answered. I spoke to an american lady who pointed out that it was a programme etc etc. I was firm and didn't rant and rave and asked for them to cancel the order. She agreed and then I asked for my money back, luckily I had already read the thread in this post and she once again agreed. Said she had sent me an email and had refunded the total £99.95. This was 15 minutes or so ago and I haven't recieved any thing so far, but here's hoping! It is false advertising, and preying on the insecurities of anyone who would like to loose a little weight. I hope that others don't fall for it until they are prevented from advertising in the national press and on the internet that is unlikely to happen.0

Well if the consumer doesn't WANT to read the T&Cs for a 'free' product or a 'free' trial that's entirely up to them

Valli, if you read the thread you will see that the T&C's are sent AFTER the transaction so it is somewhat difficult to check prior to parting with any money.
While I accept (as I have openly stated) that you are of couyrse correct in principle, I don't think these sorts of comments are helpful in a forum that is intended to HELP people. Comments that ridicule people will only serve to achieve that they won't bother sharing their feedback on here in future which defeats the purpose of this very useful website.
If people have nothing constructive to say or you think the consumer is stupid you are entitled to hold that opinion but why bother spamming a thread where people are sharing constructive advice?0 -

It took a day for me to get my refund confirmation so no need to panic yet.0 -
I actually didn't sign up to the VIP member and seems they just used my details for shipping my free sample to sign me up. I have checked several times that on the web page there is nothing about becoming or signing up as a VIP member. I even started the process of having the free sample again (but cancelling before doing any payment information) to make sure that I wasn't being the complete naive one as a lot of us seem to be called as the consumers but nothing was mentioned of it. I didn't want to become a VIP member so wouldn't have (and know I didn't) sign up anything extra after payment details. Also I checked my confirmation email and this is what I found which seems to make the "offer" of a VIP member slightly confusing having the price in brackets and then saying absolutely free, they certainly know how to win the consumers like me
"In addition to receiving a product evaluation of our exclusive Total Cleanse product, you earned access to our VIP MEMBERS program (A £ 99.00 value), absolutely free!"
Ridiculous! I'm guessing their number is only available Monday-Friday? Though I will check later.
