Refused Refund at Tesco

    I'm fairly certain I read a proviso somewhere that while Tesco (some stores) do offer 24 hour opening thay also warn that 'outside normal business hours' not all services and concessions are available.
    Probably on some advertising bumf sent out when our Tesco Extra opened.

    I suppose I should have mentioned that I was seeking a refund for an every day product, not one where you might need a special department within the store to be open and it was certainly not something that required any kind of investigation.

    All I was interested in was the legal situation i.e. if a store is open for business, can it legally refuse refunds. If I find out what the legal position is in the future, I will post it here.
  • But again they didnt refuse you - they told you to come back at a time when the relevant department was open. Thats what the CS desk is for really.

    So to recap, they did not refuse you a refund.

    I am slightly disappointed that you have found the effort to comment on everyone else's posts, but have totally ignored my contributions.

    As the OP wants to know the legal position I'll throw THIS into the mix -

    Just after Christmas some stores (BHS for definite as I remember seeing signs) refused to process any returns until the New Year; they were deploying staff to cover their Sale. This was posted about on the forums, but you'll have to search for the threads yourself if you want to verify this. Admittedly this would have covered change of mind purchases in that chain, an option extended to their customers over and above their rights under SoGA.

    So I would assume that while stores are obliged to deal with returns under SoGA and under their own returns policy, if offered, they can also choose when (or when not) to process returns, as long as they do not impose unfair terms (you can only return if there's a full moon, for instance) which would cause problems for customers. There is, as far as I can ascertain, nothing compelling stores to accept returns during all their opening hours.

    So OP you were not refused; just asked to come back at a different time. And you dug your heels in and got your refund there and then.

    What will I take from this thread? If I choose to shop 'outside' normal hours - ie after 10pm or before 6am and I want to do something other than actually shop I'll phone first and make sure the service I require will be available when I'm there.

    Actually, some of the departments (e.g. pharmacy, photo printing) close well before 10pm! :eek:

    Yes, I am coming to this conclusion myself. However I have just contacted the store manager who said that the way my refund request was handled was incorrect and there were adequately trained staff on duty to process refunds.

    Yes, they did and they were wrong to do so as the store is now acknowledging.
