ASDA and 2 hour non-return T&C

I've just had an interesting chat with someone on ASDA's customer service desk about the 2 hour non-return T&C at my local store.

I asked the question of what I am supposed to do, if I ever find that I need to return an item of frozen food after I've driven out of the car park and before I get home. I shouldn't re-enter the car park for 2 hours. It's going to be nicely defrosted by them.

Assuming that the person I spoke to was authorised to speak for and on behalf of ASDA Stores Ltd., they seem quite happy for the food to be wasted.

Talk about the tail wagging the dog.

    What would you do if you realised you had left your purse, wallet or mobile in the store? Or you had forgotten to buy an item? I really think that a store with such a policy who then issues a invoice to someone who returns within that time would have great difficulty in convincing a court that it was a reasonable term and condition.

    D'Oh! I didn't think of those. :(

    Forgetting to buy something would have been a much better example, as it would have been to their advantage for me to return.

    Maybe I should forget something important, and then ring the store to ask if they can guarantee me "safe passage", or whether they'd prefer me to buy it from a competitor instead?

    maybe if you buy something and it develops a fault, or something you can return under whatever returns system Asda opperate, you could ask for your money back, plus whatever random figure that has been plucked out of a hat and used as a [STRIKE]parking fine[/STRIKE] charge notice.

    I doubt they would restock anything frozen once it had left the store anyway.

    Of course they would assure you that you wouldn't be "fined". And then they would do precisely nothing, and the PCN would drop through your letter box anyway.

    I would not have thought that the person you spoke to was either a policy-maker or in fact properly understood the purport of the question.

    However, they were probably at least as intelligent as the senior management who have allowed this crazy policy to be foisted upon them for the sole benefit of a parasitic third party.

    I kbow what I would do if I had to return within two hours for whatever reason, I would ignore the invoice, but I would have kept proof of the return to use as an indication of an unfair contract term, denying me the right to a speedy remedy, in case the muppet PPC tried court.

    They do return frozen food-they have a small fridge in the customer returns dept.

    Love to see them prove a loss when you have returned to buy some more things.

    Do not ignore a private parking ticket - from 2013 onwards things changed in England/Wales. If yours is Parking Eye then they are suing people and so are some other PPCs.

    You must appeal and with current forum advice, you will win at popla - we win 100% of appeals in 2014.
