I originally based my court comments on the erroneous assumption that there was also fence that moved by a foot as well.which I think the OP would have struggled in court to get it all moved back. This is a system account and does not represent a real person. Will this letter stand in a court of law? where do i stand getting my land back?
Curiously enough, my understanding is that this letter helps you, rather than her, as it's probably a licence that you can withdraw. I suggest that you speak to a solicitor, as you'll just get confusing replies here from the lay people (like me!) - unless one of the very few lawyers on the forum replies ofc.No reliance should be placed on the above! Absolutely none, do you hear?0 -
Hi all
Thanks for the replies.
Yes sorry, perhaps i should have said it is an open plan front garden so i need to use her (my) part when i get out of my daughters car or a pasenger from my car to step out onto MY front but she is getting increasing difficult and took pictures of my son-in-law on Sunday washing the car as he was on her (my) part.
Its the use of the space and not the ownership, when i sent the original message to her saying i needed my front back, she emailed me back saying "have you forgotten this" and attached the permission letter, so i pointed out to her when i gave permission for block pave my part it didn't mean she owns it.
I will copy the letter that was typed up in the next message.Mortgage Jan 2007, 60000. Jan 2011, 46,132.86. Feb 2011 45,699.72. July 2011 44,722.48. July 2012 42,400.34. Sept 2012 41,673.83. Jan 2013 40,652.53

To whom it may concern
I (my name) hereby confirm, i give my consent to (neighbours name and adress) to concrete block pave onto a few inches of my land up to the edge of the drive of number 7
Signed ( me) 8th sept 1993 (my address)
witnessed by (her friend) 8th sept 1993 (her friends address).
So there you have it the "contract" of permission.Mortgage Jan 2007, 60000. Jan 2011, 46,132.86. Feb 2011 45,699.72. July 2011 44,722.48. July 2012 42,400.34. Sept 2012 41,673.83. Jan 2013 40,652.53

lol - all it says is that you give her permission to block pave YOUR driveway.
It doesn't even give her permission to USE it, let alone own it.
I very much doubt that would stand up in court!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
I agree with all the others. Your letter doesn't give permission to use it, just to concrete it - although arguably it implies permission to use it as otherwise there isn't any way to effect the concreting in the first place, nor any reason for the concreting.
You can simply write a formal letter saying that the permission given on x date is rescinded from a date in the future.0 -
I would say something like: I gave you permission to pave this land however, it remains my property and I still intend to make use of it. After being neighbours for ? years I hope we can continue to coexist happily. Any disputes we have will need to be disclosed if either of us choose to sell our houses in the future which could lower the value of both our properties so I hope we can come to some agreement on this issue.0

I think the neighbour in question has realised she doesn't have a leg to stand on, i sent her this letter
Hi (neighbours name)
I have no idea how you interpreted my last email.
All i'm saying is i need to use my part of the front garden that belongs to me without you being petty and coming out having a moan about how far over someone is and taking photos ect.
The problem you have is with ME, not xxxx, xxxx, xxxx xxxx, xxxx, ect, yet you made it perfectly clear you don't want them parking on your front (after you told them they could - minus xxxx and xxxx) and they haven't parked on your front since.
As i was saying earlier one my friends husband's dieing of brain cancer, another has breast cancer, my dad died and his neighbour stole his 13 thousand pounds, and you are worried about who walks on your front, you don't know how lucky (and petty) you are if that's all you have to worry and moan about!. Mark and Kay are 7 weeks of having their baby so will be coming on my front and may even need to get the baby out towards your side, will you take photos then as well? And what are you planning on doing with these photos, take them to the police? As it certainly sounded like a threat when you told scott and xxxx you'd taken photos of xxxx.
I did what i could to stop my chicken from going over to your back garden as you couldn't tolorate the mess she made, and what i can make out she hasn't been in since but i am sick and tired of the pettyness regarding the front gardens and who's walking/parking/cleaning where, like it is some kind of major catastophe.
If this behaviour is to carry on you leave me no choice but to take up your bricks that are on my garden and i will put a small deviding fence down and that way anyone who comes on my drive won't be intimidated by you watching their every move and taking photos.
(my name)
Some might think i perhaps have said the wrong thing in the above letter but this has been going on for over 2 years now and i really have had enough.
The neighbour replied saying she must have misinterpreted my request (yeah right) and yes it's only right you want park on your property including the block paving.Mortgage Jan 2007, 60000. The letter sounds a little emotional to me, but it seems to have worked and you know the situation better than me so maybe it is appropriate as part of on-going communication. Well done.0

Yes i think you are right about being emotional, i am very angry about the whole situation.
Unforunately she is very much a perfectionist and very opinionated and anything out of place on my property and she makes it well known as it's makes for a bad outlook from her windows...........a very bitter Hiacinth Bucket springs to mind.
Funny enough my neighbours daughter in law is my hairdresser whom im going to today BUT i asked her last night if she still wanted to do my hair due to the dispute with her mum-in-law, she said she had heard all about it and she feels so bad for me as she knows what my neighbour is like and yes she will still do my hair.Mortgage Jan 2007, 60000.
