    Basically because the British public are generally gullible, defer to perceived authority without question and have a fear of 'parking tickets'. Dress up an extortionate charge to look like a PCN and use a letter-heading from a debt collector or solicitor, or a scary company name like 'Civil Enforcement' and you are halfway to getting an uninformed hapless UK victim to get their wallet out.

    It's not illegal to send an invoice like that as the PPC would say it's for the service they provide (which they pretend is parking enforcement for landowners and retailers). In reality it's a protection racket, nothing more, and in the long run it scares customers right away whilst ripping them off mercilessly. The last thing a PPC would want is for their parking enforcement to solve all parking problems (or they'd make no money would they?).

    Yet the big retailers do nothing as they have bought into the spiel from the PPC that they can 'solve all their parking issues for free'.

    And the Govt does nothing because not only does the DVLA get millions from this racket every year, but PPCs also have friends in high places - political contacts in the Commons and the Lords. Many large PPCs are run by very rich fat cats like Simon Renshaw Smith and his horsey friends, and one wonders if money changes hands...somehow it seems that the right strings might be pulled because the BPA is certainly seen by the Govt in a different light than we see!

    And the Queen was even on a yacht owned by the owner of NCP (a toff friend) when one of her security cars was clamped in Portsmouth last year (oooh the irony!). And of course, royalty compete in major horsey events same as Renshaw-Smith and his family do...all funded by hapless victims thinking they must have got a real parking ticket.

    only the driver can agree to their "contract"

    even if the registered keeper was in the vehicle at the time.

    You weren't driving were you . . .

    and you do not have to tell them who was.

    Their parking contract is with the driver.

    ..until the Freedoms Act attempts to undo that basic rule of contract in the Autumn, by still being set to introduce 'keeper liability'.

    On the say-so of the BPA of course...to appease them for criminalising clamping. You couldn't make it up!

    On the other hand it should be possible to totally log-jam the so-called appeal system.

    What will be needed to finally defeat the pirates is a decision by a court of record that their charges are illegal penalties.

    Exactly, and it is one of the reasons, I believe, that PPC's are so reluctant to pursue too many cases and why they have pushed so hard for statutory cover. Ultimately they know that they will bite down on someone who will take them all the way and Freedoms Bill/Act or no Freedoms Bill/Act such a case could bring the edifice down.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    The BPA are boasting that they will have an "independent" appeals process in place by October. It will be voluntary - from the customer's point of view.

  • Can someone please confirm that the info re Gemini is still relevent. I paid the £1 ticket but due to a pressing need to find a toilet didn't make sure that the ticket stayed on my dashboard. Although explained in appeal they want me to pay £60 for non-display, with the threat of increasing to £100 in either 14 days or automatically if you further appeal to outside authority? POPLA
    Please put my mind at rest.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
