Redundancy while in administration

    Back to the OT, and I've filled in an ET1 form claiming against Game Group Ltd. I had a series of letters last week, one telling me that others had claimed for similar and to bundle the cases together and who they were filing against.

    The next was a 'Sorry they are in administration, this case will not proceed further until in 6 months, unless you get the administrators permission'.

    And finally the last was to say the claim had passed onto ACAS who might aqree a settlement outside of a tribunal.

    So I'm confused where I and others stand now. Do I need to re-fill in an ET1 form and label it clearly against the administrators. Do I contact them, who at the moment refuse to co-operate. Or do I just leave it and wait for ACAS to contact me like the form says?

    One final point, my redundancy payment is lower than i expected. I had a 20 hour contract and am being paid £276 in redundancy for working 3 years, 2 of which I was under the age of 22 so count as 1/2 weeks.

    When I filled in the insolvency form it asked for my hours and I went from the final letter from Game HR which stated I'd worked on average 35 hours per week, and therefore I used this in my form. That however does not equal the £276 they claim to be paying me.

    Whole situation sucks, any suggestions?

    Why are you continuing / starting an Employment Tribunal claim when you have already received your statutory entitlement from the National Insurance Fund?

    For money owed such as keyholder allowance and also the lack of notice given. Bearing in mind they shafted us over a few days before the new holiday season began and tax year.

    Don't think you have a cat in hells chance with those. Anyway they would constitute an unsecured claim in the Administration and subsequent Liquidation of the Company. You might as well download a Proof of Debt form from the net, complete it and submit it to the Administrators. You might or might not get a few pennies in the pound in a few years time. Bottom line, a tribunal judgment won't put you in any better position.
