Redundancy while in administration

I have just been made redundant from Game as we were one of the shops to close whilst in administration.

Obviously this means I can only get statutory redundancy as I have worked there for just over three years.

I've never been out of a job as such, so I don't know what my next steps are.

I know I can claim JSA, but will this impact on any redundancy pay or notice pay if I end up getting any?

I own a home with my partner, so am I eligible for any other benefits or will I have to sponge off her? She earns £16,200 a year pre-tax.

    I was made redundant last night by the Adminstrators for a company called DBC Foodservice who went into adminstration on Tuesday. Our union rep told us that we would be entitled to notice payment (1 week for every year worked to max of 12 weeks) Sta redundancy payment and also depending on the number of employe's affected we would be able to claim upto 90 days pay in leiu of consultation period(think this depends on the amount of people affected).

    This was also confirmed by the administrator this morning.

    You should get redundancy pay, 3 weeks pay in lieu of notice and any accrued holiday pay.

    I believe you will only be able to claim JSA for 6 months. Nothing else because of household income.
    Its not a case of sponging off your other half, its called supporting each other, think what you would do if the positions were reversed.

    I dont think you would get paid for consultation period, but pay
    in lieur of notice certainly.

    Aged up to 40 years of age you are correct, 41 or over it is 1.5 weeks for every year.

    Yes you get redundancy pay and pay in lieu of notice, any JSA claimed between now and the redundancy payout is taken of the notice pay whether you claim JSA or not its still taken of as you should of claimed JSA. It may also take a while for a payout, I got made redundant in January, still nothing received.

    Thanks for the info. What if I only claimed JSA after I was paid any redundancy, do they reduce the payments to take the previous into account. Obviously I will get my partner to support me, and I want to get a job as soon as I can. Do I not get any other benefits having being paying tax or is that a myth?

    Nope its still taken of you as its deemed you should of claimed it.

    I've had my pack from the administrators today with some notes and the forms to fill in.

    I worked for 3 years on average hours of 35, therefore I'm entitled to (I think) £638.40 in redundancy payment. I did get a keyholder allowance of £96 a month, however I guess the payment will just take into account any hours worked not the extra payment?

    It also says about statutory notice, again 3 weeks for each year which will be the same amount but subject to reduction by any JSA. It also says about any contractual notice, which can be claimed during the insolvency period? I guess that's if the business gets purchased and you have to claim this seperate?

    It also says on the notes not to say that any outstanding holiday pay was due. The holiday year ended on 31st March 2012, therefore it states all holiday should have been paid. My argument is, that if we were given our statutory notice period, then that would have taken us into the new holiday year, therefore we should be entitled to this as well. Any thoughts on this or wishful thinking?

    I think its wishful thinking to be honest although I am no expert.

    Yes, but be fair - you haven't received anything because you have been told by the RPS that they don't believe it is a legitimate redundancy. So your case is hardly typical.

    Most people I have read on here and the few I know who have been made redundant like this, the payments are generally taking about 6 - 9 weeks.

    Oh don't I know it.:mad: 18 month court case looming. But yes my case isn't typical.
