Court date set for Bank charges...Anyone else??

    The case was against 'Citibank' - They had originally paid out the difference between the OFT's £12 (NOT REALLY A LIMIT ON A FAIR CHARGE AT ALL) and the actual charge of £14 I believe and the case was for the rest. It's currently under appeal, they used some 'new' evidence which was produced on the day of the actual hearing in secret shown to the judge only - some might say they had something to hide???

    With 'full disclosure' (i.e. they will have to PUBLICALLY provide proof that it costs them £12 for a 'referral charge' or whatever they call it) I would think a reversal of the original judgement is very much on the cards but I would assume they'll settle before it comes to that.

    The same person with this case has also received full settlement in 9 other claims.

    Is there an appeals procedure for the small claims process?

    It was on CAG that I read about the story, I'll go back to get the latest updates.

    I successfully claimed money back from Halifax and MBNA. Both got to the court date stage and I recieved cheques in full literally the day before in both cases. There always is the risk that they will actually go to court and so you should be preferred for that before you file a claim against them.

    I know what your saying, but this is my 3rd bank charges claim (2nd one of Nationwide) and the circumstances arent the same as they were with the other 2 claims (I`ve successfully won those no bother.)
    I hope youre right there Honey - I`d rather it was settled out of court but I will give a good case if I have to go. Fingers crossed and I always look out for the postie in case theres any good news!!)

    Hi baileyslad,
    I filled this claim and got the papers sent back to me to sign that I wanted it served in England( cos this ones based in England). That delays it for us a bit...Roughly - filed claim end of December, They had till 8th February to pay...They `paid me`(didnt really cos of my IVA dispute with them) 12 January...If my memory serves me well It usually takes 15 days over here before you see any money. You`ll get more info on this in the Bank Action Group website.
    BTW - I`ve claimed twice already successfully :-)

    I have just sent my first letter off to the Nationwide requesting all the details of the horrible charges to be sent to me :mad:

    We won a claim against the Nothern Bank on a farm BUSINESS account £600+
    Claimed back these items:- Referral Fee, Unpaid Charge and Warning Letter

    Story......briefly.
    Jan wrote to them asking for all the penalty charges listed to be refunded

    Received back a letter saying they would look into the matter and that their charges were fair this would take 20 days blah blah blah

    Rang us to discuss the matter because we no longer banked with them.
    Promptly told them we refused to discuss the matter with them over the phone....... end of conversation...smiles.

    Received another letter (2 Feb) saying they would look into the matter and this would take another 20 days....blah blah blah ( more delaying tactics)

    Their time was up on the 30 Jan according to OUR timetable so we filed against them online on 1 Feb!

    Heard nothing from them only what we saw online.

    They lodged a NOTICE of DISPUTE on 22 Feb

    Then they filed a Transfer (Civil) Case on 27 Feb which basically means a defence which meant a court hearing at some stage. (all of this is standard procedure with the Northern Bank)

    On 3 Mar received a Letter dated 28 Feb and a cheque enclosed for full amount which covered interest and court fees and MORE ( lol.....they cant count! )


    So dont be intimated.........Claim your money back!!
    Every penny is a prisoner.......

    Hiya, I also successfully claimed back all my bank charges, interest and court fee from Nationwide -they closed the account, but I see on another thread people are successfully fighting this as well -bit nerve racking the whole process, but well worth it!!:D
