Who Owns The Phone During A 24 Month Contract

Hi all,

I recently moved house, to an area Orange said was 'very good' yet I found I could never get signal.

After months of telephone tennis, Orange have given me the option to cancel my account. But, only if I send them back my iPhone!

At the beginning of the contract (around 11 months ago) I paid £200 for the phone, on top of my £25/month contract. Does this not mean I own my phone, and paying £25/month for their 'service'?

Any help would be great - I've looked over my T&C's but can't see anything about the matter.

    You paid a little up front to reduce the contract agreement, so if you really want to get out of the deal, send the phone back, as it is no good to you if you are not able to use it.

    The phone is still of use, as I was going to move to GiffGaff (02 signal works in my new home) and continue using that phone.

    I know it sounds harsh, but no network can gaurantee 100% service anywhere, there will be many factors that affect the radio signals GG may work out cheaper than the £25 per month, but when you signed on the dotted it was for 24*£25 :o
    GG will still be available after your minimum term has passed (along with a new version of iphone) .

    Orange have already agreed to close my account, but only if I post them my phone.

    My main argument for closing my account was section 4.4 of Orange's 'Pay Monthly Terms - Terms and conditions for the supply of Orange Network Services' (sorry I can't post a link as a new user). This seemed to be a valid argument with the call centre staff.

    I forgot to add, is there no T Mobile signal where you are either?
    Seems odd for neither to be available.

    No T-Mobile signal either, the call centre staff called the area I live a 'dead zone' - a random patch of no signal for either network.

    Yet, my family are on 02 without any issue.

    Ask them for the £200 back you had to pay for the phone. (They may think you got it "free")

    Thanks, I have mentioned that to them, but maybe I need to make it clearer and fight my corner a little more!

    If I had apart of the Orange contract that told me I owned it from day 1 I'll be sailing!

    maybe you should try and get the 200 and send the phone back a little give and take

    The contracts says under what circumstances you have a right to cancel the contract and losing signal because of moving house is not among them.

    The phone is yours, but you have no rights to cancel the contract. Full stop.

    What you are negotiating with Orange is not covered by the contract. You can take it or leave it; you can haggle, but you are not in a position to demand anything.
