  • I've had another reply and am sorely tempted just to ignore this from now on, particularly since the rules they've quoted aren't the same as on the station car park notice board. I'd appreciate your input though on the letter below:

    Thank you for your further correspondence regarding the above Parking Contravention Charge Notice (PCCN) issued at our XXXXXX Station SP car park.

    As you are aware the parking contravention charge notice was issued to your vehicle, as the parking attendant observed and recorded that the vehicle was parked in a bay without a valid payment for parking.

    I do understand the points you have raised, however there is very little that I can add. The terms and conditions of this car park are clearly situated at the front of house and it is vital that all customers comply by these at all times. Please be advised, the terms and conditions apply regardless of which payment method is used.

    9. TICKETS

    (a) The ticket issued to you is only valid for the vehicle in respect of which it is issued. A ticket (including a season ticket) does not entitle you, unless otherwise specified, to any particular space in the Car Park or to priority over other customers. Upon entry to the Car Park, if you are unable to find a space for your vehicle then you should exit immediately to prevent any parking charges from arising.

    (b) In pay and display car parks you must do one of the following:

    (i) purchase a ticket before leaving your vehicle in the Car Park and ensure that the ticket is clearly displayed in the windscreen of the vehicle;
    (ii) clearly display in the windscreen of the vehicle a season ticket valid for the Car Park and comply with the season ticket's terms and conditions;
    (iii) purchase the time you require to use the Car Park using the cashless parking service NCP Fastpark in accordance with its terms and conditions.

    In all other car parks you should take your ticket with you to make it more difficult for someone else to remove your vehicle without your consent.

    Unfortunately the parking session you paid for covers you from the time of payment and cannot be applied retrospectively. At the time the PCCN was issued, you had no valid payment in place and hence the PCCN was issued correctly.

    I have again considered your challenge carefully and the decision remains the same. The amount of £50.00 must now be paid within 14 days from 11 June 2012 in order to conclude this matter.

    Payment can be made:

    Online or by sending a cheque or postal order, made payable to National Car Parks Ltd to: National Car Parks Ltd. Notice Processing, PO Box 839, Northampton, NN4 4AL.
    By Debit or Credit card (except American Express). Please call 0845 452 7780 and have your card details and the information held in this email to hand.

    If payment is not received within 14 days from 11 June 2012, the discount offer will expire and the full amount of £75.00 will become due. I have to inform you that if the outstanding amount remains unpaid we will follow a recovery process which includes passing the case over to a debt collector who will seek to recover the outstanding debt on our behalf and any reasonable administration costs incurred by the debt collector. We further reserve the right to use the courts to recover any outstanding parking charges due to us.

    Sorry to go back to this again: are you 100% sure they won't start sending out a debt collection person to the registered car address? This is my biggest worry, as I don't deal well with bailiffs at the door (never had them for me, but have had them for previous owners/tenants in the past).

    Is it worth me going back on their online appeal thing and basically telling them that "I'm" not the registered owner of car and that the owner won't be giving up my details? Would that potentially lead to bailiffs at the car registration address or a court summons for the car owner (ie me)?

    PS Hubby is indeed a bit pathetic on this... he's been winding me up about it. The thing which worries me most is that I'm away for over a month this summer, so won't be here to deal with any fall-out.

    You seem to be confusing powerless debt collectors with bailiffs. The former will never come to your door, and the latter will only get involved if the case goes to court, you lose and THEN you refuse to pay whatever the judge orders. Stop worrying and please stop contacting these clowns.

    You're getting drawn in. You shouldn't have 'appealed' - what response were you expecting?

    Stop engaging with them.

    Simply ignore.

    P.S. Don't confuse debt collectors and bailiffs.
  • As I said in my original post, I didn't know that then... if I had I'd never have responded. :(

    ETA I'd expected them to be reasonable human beings... clearly I got that bit wrong!

    Yes you did expect to be dealing with reputable people. I am not going to tell you off because if you have had no previous dealings with firms like this it is something a LOT of people wrongly think.

    You are dealing, in fact, with a semi-legal scam whose only purpose is to extract money from you.

    It is done by what my friend Vax describes as the "impersonation of authority". They imitate people who actually DO have some authority, like councils.

    They send carefully- worded letters to give you the impression they can do this or they can do that- when in fact they cannot and will not do sod all.

    This is a large national company; but it is important to understand that it operates in exactly the same way as every little back-street parking cowboy company.

    By the use of bluff and bluster and trying to scare you with threats it cannot carry out.

    This company realise full well that the "bill" they have sent you doesn't have any legal standing and can't be enforced in Court.

    So they never try. They see if they can browbeat you into paying, but, if they fail to do that, then they just say, "oh well" and give up.

    They rely on the substantial proportion of people that are fooled by their ploy.

    Do not be one of those. See through their game and do not play it.

    Totally ignoring is the response they cannot deal with. So long as you engage with them they think they will talk you around because you make them think that you are taking their FAKE ticket seriously.

    100% sure they won't and can't send the boys round.

    Debt collectors are not bailiffs, they just write letters.

    You can just play a nice game of snap with each letter that matches our sticky thread called 'PPC letters & threats'. It's easy.

    I've also received a notice from NCP entitled "Parking Contravention Charge Notice" and was just about to press submit on the Appeal button when I thought I'd check in here and have a look.

    My contravention is not for not paying or a delayed payment but "Not parked correctly within the markings of the bay space" at our local Railway Station

    I was not parking in a marked space as there were no marked spaces available but the space I did park in was not causing an obstruction, I have no idea why there was no marked space there but maybe there was a vaild reason, the car park was having some work done on it so no spaces were left when I got there. I have also used the same space previously with no problem.

    Do I appeal, do I ignore or do I pay up as I realise my parking breech is not the same as others?

    Some advice would be appreciated
