NCP PCCN - appeal declined?

So. Need a bit of advice on a NCP PCCN ticket I have received.

The story is, I parked at the train station at around 11am ish. Jumped on a train and went on the ringgo app to pay for parking. Went through it all and paid for parking. I've parked using the app before and always got a text to confirm payment. By the time I had got to work at around 12:30 I realised I hadn't received a text. Went back onto the app and couldn't see details of any current sessions for parking. So I paid again... This time I received a text.

End of day, go back to my car and find a PCCN stuck on a window...

Time of issue 11:30...

I appealed this and just got this reply..

What can I do now? They have my name from the appeal. Who can I complain to about this?!

(I have checked and the ticket has nothing about railway bylaws)

Another thing I should probably mention is that the own is owned by a family member... So if they did a dvla search it wouldn't be in my name...

I appreciate that it must have been frustrating to return to your vehicle to find that you had been issued with a PCCN. !We encourage the responsible, safe and considerate use of our parking facilities by all our visitors, and occasionally we have to enforce these standards by issuing a PCCN which is a necessary part of keeping our car parks functioning properly for customers who use our service.

The above Parking Contravention Charge Notice was issued to your vehicle as at the time of issue, the Parking Attendant was unable to find details of a payment made by Pay By Phone.

I have searched for a payment made using the RingGo system, and although you had made a payment, the Parking Contravention Charge Notice had already been issued. The notice was issued to the vehicle at 11:39, your payment was received at 12:29.

By parking in our car park, you indicated your acceptance of our terms and conditions. !In the case of our Pay & Display car parks, these conditions include the requirement to pay for the parking in advance, either at the payment machines or by using the RingGo telephone payment service.

I have considered your challenge carefully and, unfortunately, we have declined your appeal to cancel the PCCN. I therefore request that you make payment of �50.00 within 14 days from 28 March 2012 in order to conclude the matter.

By sending a cheque or postal order, made payable to National Car Parks Ltd to: National Car Parks Ltd. Notice Processing, PO Box 839, Northampton, NN4 4AL.

If payment is not received within 14 days from 28 March 2012, the discount offer will expire and the full amount of �75.00 will become due. I have to inform you that if the outstanding amount remains unpaid we will follow a recovery process which includes passing the case over to a debt collector who will seek to recover the outstanding debt on our behalf and any reasonable administration costs incurred by the debt collector. We further reserve the right to use the courts to recover any outstanding parking charges due to us.

    You paid to park so you don't owe them a penny. This is a private parking ticket and the only amount they can claim from you is the actual loss they have suffered. In this case it's a big fat zero. Just ignore them from now on and all the silly but meaningless letters they might send you.

    Well you have now learnt that there is no real appeal to a private parking charge - they are all scams and only very, very occasionally allow an odd 'appeal' as a sort of showcase for the BPA (their trade body which is friends with the DVLA).

    You should have just ignored it but can do so now. It's not too late, you just took a scam seriously that's all.

    You must tell the registered keeper that he may get letters (all shown in the top thread) but that the whole thing is a well-known scam already outed by Watchdog 2 years ago. In fact they are covering the issue of DVLA data release to dodgy private parking firms again tomorrow night.

    Read the top sticky thread called 'PPC letters & threats'. It has a link to the 2010 Watchdog show with a solicitor telling people about these fake PCNs and what to do with them.

    It also has a preview of the letters to expect in pictures on that thread. THey might send them to you now they have your address, or they might pay £2.50 to farm the registered keeper's details even though he's not responsible as he wasn't driving. All part of the scam.

    Whoever gets the letters - ignore them. SIMPLE, even I have done it. :D

    I would ask them to send all correspondence to you then tell them to take the matter straight to court, do not mess about with silly letters, get straight there.
    Of course they will not as they have not suffered a loss and by not refunding the second payment, they actually owe you !

    That would be a bit difficult seeing as NCP don't do Court. Ever. :)

    They will if you take them to court for the second payment they clearly owe you. If they don't cough up first, of course.

    Threatening to taking someone who owes you money to the local county court is very easy.

    Actually taking them to court isn't much more difficult. Just have a rummage around the HMCS MoneyClaimOnline (MCOL) website. As the name suggests, you can do it online, and it only costs you £30, which is added to your claim if it gets that far. Talk about win, win.

    I've done it twice, and both times they (MINT & TalkTalk) paid up, plus my £30, just before it was due to get to court.
    The acquisition of wealth is no longer the driving force in my life. :)

    So you have to pay before you park up then, maybe get a passenger to jump out before you enter the car-park in order to pay for the parking in advance or risk a million pound invoice :rotfl:

    You paid up, just because they computer system probably is slower than sending a message from the north pole to the south pole using smoke signals doesn't mean you owe them a penny.

    Your appeal to them was unsuccessful.

    Fortunately, there is a higher court you can appeal to.

    It is called yourself. As you did nothing wrong, you should allow your appeal and pay them nothing.

    As has been said above, NCP are too smart to actually do court, so if you ignore them that will be an end to this ridiculous episode.

    just cannot believe you lost your appeal ,,outrageous really, due to the fact it was a fake ticket, so fake appeal,fake result and fakeall will/can happen to you,,relax, chill, feet up, go trainspotting,,ignore everything you recieve on or on behalf of these clowns.

    Like ALL PPCs they just want your dosh! let the thretograms come and do the scroutes for harassment ;)
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
