Just bought a lemon...

Hi All,

I recently traded my 2002 Audi 1.8 T-Sport plus cash for a 2007 Chevrolet Lacetti, at a used car dealership (non-branded).

Test drove the Lacetti, all seemed fine, and the deal was made.

I'm now driving the car a few days later and after 10-15 minutes at motorway speed (I commute 80 miles round trip a day) the ABS warning light comes on.

It's almost certain the issue pre-dates the sale. I've emailed the dealer asking him to repair.

If he refuses, I intend to refuse the car under the Sale Of Goods Act.

In order to proceed through court, I'd need an engineer's report - will I be able to claim the cost of this from the dealer?

I also rely on my car for transport to work - if I refuse the car on the basis it was not sold in satisfactory condition, can I claim for alternative transport arrangements, minus cost of fuel I would have used?

Frankly I wish I'd just repaired my Audi now...

    Presumably the car came with a warrenty (90 days seems standard for most non franchised dealers). Can you not take it back and ask them to fix it under warrenty?

    If an ABS warning is the only thing that has gone wrong then i think you are a bit hasty to call it a lemon and mad to even consider legal action at this stage.

    Please tell me you were polite to the dealer when reporting this issue and you didn't go straight in with the old sale of goods act, you must fix this immediately, unfit for purpose etc??

    So you gave him a lemon, and he gave you one back? Or did you point out your Audi was knackered?

    I think you are getting a bit ahead of yourself there.

    Why not go back to the dealer and ask him to put your lights out? :cool:

  • Might just be brake pads getting low.I've also had an issue in the past where a duff battery was causing the abs light to come on.

    NB: The dealer noted all issues wrong with my Audi and offered a p/x value appropriate - under no circumstances would I mislead him.


    I've been very polite, given he was friendly and amicable during our exchanges, and he's going to take a look at the brakes for me.

    So yes, possible over-reaction here, just prepping the ammunition should it be necessary. The car might not be a complete lemon.

    ABS sensors can just go without warning. It is possible (though statistically unlikely) that this fault appeared spontaneously and your dealer knew nothing about it.

    It's hardly a terminal fault -- the sensor is £40 from a main dealer and will take under an hour to fit. I can't see the dealer being anything other than helpful.
  • Why email them? Pick up the bl**dy phone and speak to the dealer direct.
