I'm ill and my work want me back tomorrow!!!Please help

    The messages are on voicemail and are only saved for 7 days as far as I know. Anyone know how I can save them indefinitely?

  • Do you have a tape recorder to tape them or a recorder on your mobile? Somebody will be along soon and may be able to tell you how to save them on the actual machine, is it a BT integral answer or an answr machine.

    In any event you could write it down word for word, ask a colleague or a neighbour & friend to witness it. Perhaps you should ask HR to come around to see you because you are so distressed and let them listen to his messages.

    You could file a grievence against this guy and if his behaviour does not become more supportive all will be on record and you could do him for constructive dismissal.

    This is what I menat by preparing you for back to work meeting. You wnat it on record your actual days off poorly to date. You want him to hear those messages or read them and acknowledge how distressing and unfair they may be and you will want it on record that you are anxious he may start to pick on you for other matters now you have challenged his behaviour.

    You could ensure these matters are covered in a return meeting or raise a greivence completly seperately. Either way, you need all of this on record because if he does get at you unfairly in the future you can demonstrate a link. Insist on notes of all meetings and do not sign them until you are happy they are a true record.

    The top and the bottom is he cannot behave toward you like this, he needs to develop his management skills and understand when and how to deal with matters of this nature. If he did think your sickness was high, clearly this should hve been raised with you at the time it occurred, not left as a message on an an answer phone whilst you were off poorly ........ bad management practice and if nobody points this out to him he will continue.

    lesandflynny, thank you for your help. Our HR department is in London so no hope of them coming to see me but I will hopefully get a chance later so I can write down everything word for word! I feel discrimanated against but I don't understand where or why he would say that I have had all this time off? where has he been? It's the second month of the year and I haven't been off once. I also have never taken a day off just for the sake of it.....I will get hold of HR again tomorrow so I can find out for sure how many days I have had off in the last year. But I know it's definitely less than 5!

    If I challenge it you are right about his behaviour toward me......I just want to yell at him and say let me be sick.....I don't need this stress right now....it certainly does feel like harrassment.....especially - the one about me being ill tomorrow so I must work all day tomorrow and he knows it's not possible because of my childcare arrangements so why make this so difficult for me?!

    Forgot to add that I don't have a tape recorder.

    Have you got anybody close who will come over and tape or write down what his message says...word for word. They can sign and you. Then get another friend to listen and witness too and then another 4 should hold up in court! Failing that, do you know anybody who holds a position in the community i.e. church, solicitor, Dr, magistrate who could witness.......these type of people never lie (!)

    Don't worry about it now for tonight, settle, get your little one settled and try to get some rest. If you do muster the energy write down the message or at least start on it.

    don't worry about it if docs signed you off all week then take it he cant fire you for being ill he'd have to prove you were taking too much time off and as you got doc note then that should be proof enough you are ill, if he tried to fire you it would come under unfair dismissal.....

    my hubby has got the same thing i think and i had to stop him going in today ( hes an electrician so not good for climbing ladders and using power tools ect...!)

    take care and try to not get too het up about it, it'll make you feel worse !!

    Keep a record of everything. Make a note of the phone call including time. If you ever go to tribunal, you can make a request of relevant documents. This would include the company phone records that show your boss made the call to your home.
    Get a record of your sickness, and ask for a copy of the overall sickness levels in a) your company and b) your department. Sickness and staff turnover are recognised as the key indicators of a badly run business, so if there is low sickness, you need to prove that your level was no more than anyone else, and if there is high sickness, it is evidence that the company is making unreasonable demands. Bear in mind with tribunals, it is not a foregone conclusion. You say you were of last year, but for how long? If it is a small company they may be inclined to side with a small business owner (particularly if they have less than six employees), if he can show your sickness is affecting his business. Also, if you have not been calling in your sickness, and just don't turn up, they will reflect badly.
    It could be that your boss was having a bad day, and your absence was the last straw. It may be an idea to ask to talk to him, and say how the message upset you, since you felt you were a good employee.
    If he is still acting an idiot, take it further.

    I was sick less than 5 days last year. It's not a small run company....there is more than 300 branches across the country. Staff turnover is quite high and even when I'm there others b**ch and moan when someone is sick.....it's very unfair! I have never lied and I will find out the exact dates I was off to prove to him that I am really upset about the accusation he is making about me being off....he must be getting this information from the air!!!!!!!!!

    I'm guessing that he won't phone me again since I have gone through HR....but I know if I did then he would just make me feel guilty for being sick!!! I know it's come at the wrong time but what else can I do. Also, what I have is contagious and if I weren't ill I would still need the time off to look after my little one....what could he do then?!
