Hi,

Just wanted to find out if my neighbor is committing mortgage fraud, and if so how can i report it.

The guy who owns the house calls himself the landlord, and he lives there with his friends. Now i am not sure if he has a private mortgage which may not entail him to allow tenants? or does this have to be buy to let mortgage? and if so, can he live there with them?

How can i report this?

    If he lives there he does not have tenants he has lodgers which are allowed. He may however, not be declaring this for tax purposes.

    Thanks all for your reply.

    The reason is because the tenants are always making very loud noise and partying til 4 am.

    Now the council is currently investigating, but i have seen alot of dodgey stuff going on, for example them smoking drugs.

    If you have a family to raise, you will understand that this can be intrusive.

    You will not be able to identify the type of mortgage the neighbour has as this info is not in the public domain.

    If you download the deeds at the land registry you will be able to identify the owners name and perhaps the mortgage company.

    A live-in owner with lodgers can have a conventional residential mortgage.

    For noise issues, the council will have a noise abatement team.

    Check the local council website to see if they have any information on HMOs. There are certain rules and licencing schemes but this depends on location, type of property, etc, and is quite a complex area.

    Only in Scotland, are landlords expected to register their information on the national landlords registration scheme.

    Have you tried talking to them about the noise? That might be a better idea than trying to get them arrested for a crime when you've no idea whether they're committing it or not.

    Just mind your own business about the owner,

    report the noise by all means but just butt out of the rest.

    Enhance your own life so its a bit more productive.

    If you do really want to take some action against him (I'm not endorsing or criticising this), then:

    1. If he is living there and has lodgers, he's unlikely to be committing mortgage fraud. Mortgage fraud is when you deliberately lie at the point of application for the mortgage.

    2. He may not be declaring any lodger rental income for tax. HMRC have a reporting line.

    3. Depending on the number of lodgers which he has, he may be in breach of the HMO (House in Multiple Occupation) rules. This is a matter for your council.

    4. As regards the noise and anti-social behaviour, it sounds as though you've already got the council involved in this one. If not, keep a diary of what's happening for a couple of weeks and then contact them.

    5. If the council aren't dealing with the drugs issue, contact CrimeStoppers or your local police station and report it.

    Frankly, unless you really really want revenge, concentrate on 4 & 5, with possibly 3, which are likely to best improve your own quality of life.

    BigAunty and Yorkie1 have the information you need. You can get the Land Registry link and the reporting Tax evasion link, from the sticky "Renting? Check your landlord got permission to let that property" sticky, at the top of this board

    I usually find that people who say things like "mind your own business" to these type of posts, have something to hide themselves.
    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.
