    Thanks for the wealth of information from everyone.

    The issue we have at the moment is that our neighbors start to play REALLY loud music after Environmental Health are closed, like yesterday 3 am. The music goes on till 5am.

    So, I think they know when environmental health operate, and adjust the level of noise accordingly.

    At the moment we can't prove this as it is out of ours apart from calling EH and keeping a record.

    We were told at the time of buying our property that the neighbors who got the mortgage are a couple, but our neighbor himself told us that he has tenants, so its a matter of trying to prove that they have tenants, but not going through the proper channel.

    I will download the information from land registry as the first step, but they are unavailable today.

    So at the moment we are stuck in a rut.

    If the landlords address on land registry is different from the property address, then he has a BTL mortgage.

    The question is whether he is living at the property? If he is then the tenants are lodgers and all legal.

    If he is living elsewhere and letting to tenants on a residential mortgage, you could notify the mortgage lender. Chances are they will write to him at the property address and the letter won't reach him. If they do make contact, chances are they will apply a penalty to his mortgage or suggest he moves his mortgage elsewhere. Should he ignore the lender, they could in theory apply for repossession, but I haven't heard of any cases WHERE THERE ARE NO ARREARS where this has been done. You could notify (the police?) of suspected mortgage fraud, but TBH I doubt they will take action, only if the lender pursued them would you be likely to see a result.

    Have you spoken to Env Health about the noise yet? If not, do so.

    They will require you to keep a noise diary. They may also have portable equipment which they can lend you to record what's going on.

    Do you have video recording capability on your phone? Use it.

    Thanks for your feedback.

    Yes i have spoken to EH, its an ongoing investigation, however my neighbours seem to know when they EH closes at night, and then crank their music up which is usally around 3:30 am - 5 am.

    I am on my ends wits with this, as EH do not get the proof they need to serve notice.

    With respect OP, you have been told several times here what to do. You need to keep a diary of the noise issues - EH will send out after hours inspectors if the problem is bad enough, but you need to give them the proof. Record the noise, preferably in video format with some proof of the timing - record with shots of your TV on text screen/Freeview screen showing the date and time of the recording you are making, so they cannot claim you have fiddled the time on the recording.

    Do this for 7 days, then present your evidence to the EH. They MUST investigate, but you need to do something towards it first - rather than just coming back here telling us the problem again and again which will not help your situation any further.

    If you suspect any illegal drug taking, report your concerns annonymously to the police through their Crimestoppers line.

    As previously mentioned, if they are lodgers, or even just friends staying with the homeowner, as long as he is still living there, the mortgage company wouldn't be the least bit interested.
