They're now saying that they will replace the hire care they originally gave me and replace it with a car more alike to what I had (my Mini)...
And also warned me that if I now accept a car from my insurer/broker/claims handler, that I will be liable for the rental costs as he's not gonna pay for me to use a rental when they are a rental company themselves.
Is this true??Just don't let your own insurer send you a credit hire car, in place of the third parties.
They will be very keep to upgrade you as well.

Some of the cheapo end brigade such as the Admiral group will load you but many others will not. From my research going through renewal after similar circumstances in January, around 10% of companies did.
However, far more companies increased premiums simply for resubmitting your data. They have introduced the fuzzy logic yield management system that airlines use, where prices go up even though no more seats have been booked, merely because more people have requested a quote (even though it is you twice !).
You need to use made up data which exactly matches your own with registrations obtained from Autotrader to get your quotes. If you fire your name, address and reg in every time you'll end up with higher premiums.0 -
Legally you must inform your insurer of the accident, Ring and tell them the vehicle has been involved in an accident and you are calling in for 'INFORM' only
The operator will then add a note to your file etc. Then ring any solicitor to handle this claim for you. As you have a witness this case is in your favour.0 -

The rental company who told me they'd cover the costs of repairs and provide a courtesy car didn't want to agree to the document I sent over to them and told me to make a claim instead.
I've since spoken to the claims handling company (Drive Assist) that my insurer put me in touch with... They've said that they would not be able to pursue a claim as having spoken to the rental companies insurer, they've been advised by the rental company that the rental company can cover all costs of repairs and provide a courtesy car and therefore, according to the claims company, they cannot pursue a claim because of this..
Does this make sense?

Speak to insurer again, not driveassist. Also, what "document" are you referring to?
TBH, it doesn't surprise me that the rental co. doesn't want to deal with you with all the fannying about you've been doing.0 -
Fannying about? I was just trying to avoid getting stung.
I authored a document outlining what myself and the rental company had already agreed to in principle, such as the recommended repair shops, the like-for-like vehicle replacement, servicing at BMW to ensure everything is ok.
They did not want to agree to it and did not want to comment as to why. They advised me to proceed with lodging a claim.
I then advised the claim handler to proceed yesterday evening and today received a call from them and they said "we would not be able to proceed with your claim as the rental company responsible for crashing into your car have advised their insurer that they WOULD be willing to provide a courtesy car and cover the costs of repairs and would therefore the insurer would not payout on costs incurred by by obtaining these services elsewhere".
But quite clearly, they HAVEN'T agreed to cover these costs, as is clear in the email response from them yesterday morning where they stated they would not and advised me to continue with a claim.
So I'm not sure where that leaves me!?
Surely someone should pay for this damage???0 -

As the car owner you are obliged to mitigate your costs. When the claims handler/ambulance chaser company realised the hireco were offering you a reinstated car and hire car, there wasn't anythng they could add on and charge someone for and hence they withdrew.
The hireco, already having made the offer, had your tacit approval, had that withdrawn and now chased by aforesaid company now also have you wanting your common rights plus it to go back BMW for checking. That's why they have thrown their hands up and you should now go direct to your own insurance company and leave them to sort it out.0 -

I had a parked car written off by a hire car. No witnesses, Driver legged it and tried to claim the car had been stolen. I contacted my insurer, they handled it.0
