I've notified my insurer as instructed.. What would be the disadvantages of just dealing with the Hire company that crashed into me?
When I had my accident I needed a car the same day, my insurance got a company called Albany Asssistance to give me a car who were useless and gave me a rubbish car. TP admitted liability, arranged a proper hire car (had the choice of Mini, Mercedes or Pug to replace Golf) and sorted everything.0 -

I've had crash too but have REG NO. of car but no insurer details.
how would i go about getting the TP insurer to repair the car.
(Im not even sure if they have admitted liablity or have refuted my line of the story)
My own insurance company have said if you want us to sort the repair out call back (they will claim money of TP they said).
really not sure how to proceed.
My accident management company have said, as you point out, that the car may be written off. I'd prefer a straight repair (Ive never had a CAT D before and dont know if insurance will go up or not)0 -

So from that I gleaned that you have been in an almost identical situation to myself? Was the third-party you referred to a hire rental like in my case?
Basically the hire company that crashed into me told me that they would much rather deal with me directly than me claiming off their insurance and they said they'd upgrade my courtesy car to a Merc C-Class and take it to the nearest BMW-approved garage for repairs...
So it sounds like a pretty good deal no?0 -

I can understand the hire car company wanting you to use their vehicle while yours is being repaired as it will be much cheaper for them and you are supposed to mitigate losses so it makes sense.
If they have also agreed to have your vehicle repaired at an approved garage that sounds fine too.
Where you may come unstuck is if they decide it is a write off and not worth repairing. However if that did happen they still have to put you back in the position you were in before the accident which means a payment which will buy a car with similar age and mileage.
Glad you decided to inform your insurer.
Do you have legal protection on your insurance policy? If so, you could use that to claim for the possible increase in your insurance premiums for the next 5 years.0 -

Thanks for the response. Yeah, you're right, they're certainly offering me a fair and attractive deal. They mentioned that if it is a write off, they will make an offer on the car, for which I'm obviously allowed to counter based on similar car. And apparently, if we still can't agree, I'll still be able to go to my insurer, no?0 -

Do you have Legal Protection on your car insurance policy? Is it usually an optional extra which costs £20-25. If you have that then you can instruct them to work on your behalf.
Many insurance companies will increase your premium if you have been involved in an accident, even if it is non-fault, as statistics say you are at a higher risk of having another accident. Even though you were nowhere near your car and do not think you are a higher risk, it may be that there are a lot of similar accidents in the area where your car was parked.
Not all companies increase premiums for non-fault accidents so you will have to get a lot of quotes at renewal to see who does and who doesn't.
One way to find out is to run a dummy quote for the same type of car, post code area and a false name both with the accident declared and without it to see what the difference is.
The OH was involved in a non-fault accident 2 years ago. I called our insurer to have the car recovered as it wasn't drivable and informed them "for information only".
By the time we got home and called the TP for their insurance details, their insurer called us and said they would take over the whole of the claim, including hire car, repairs, etc as the TP had admitted liability.
We never had to speak to our insurer again and at renewal OH's premium only went up about £10 from the previous year. That was with CIS.0
