I do not agree - they may only declare on your Experian but have access to the Equifax information, especially on CCJ's and defaults.
The lenders system is more calculating than just looking at an Experian or Equifax score and taking a view..

Im open to telling the mortgage lender upfront about the ccj any way without waiting for them to see it first i just think that will look better but probs not in the world we live in now :-)
Spoke with my wife last night and we are going to stick to the originally suggested idea of keeping my broker in the background for now and just keep trying to keep getting our rating to as good as it can be considering in the next 5-6 months..
My rating has alrdy gone up by 15 points in the last 2 weeks by just doing some tidying up on it though i realise it wont make much odds with the current ccj on there..
My final question though is this, If the ccj is still on my record but is satisfied (albeit recently) and over six years old will the lenders still look at this as a deal breaker?0 -

That's not true. If the op ccj is only on equifax and not on experian then nationwide will not find out as they only do all their mortgage credit checks on just experian. This is all all stages - initial application, identify checks and by their underwriting team.
Also if the ccj was to drop off after 6 years from his equifax. No mortgage lender will find out or care to investigate if the applicant had a ccj in the past.

Your solicitor will not be involved in what your credit file entails or what your financial situation was in the past. By the time your solicitor is involved that would have meant that you had been approved and a mortgage offer sent out.
If it is not showing on your experian file then it's a question of morality if you can declare the ccj or not during the application process. Obviously you will get found out if it's on your experian file but if it is not then nationwide will not find out.
So as said before if your experian file is clean then they must have turned you down purely on affordability or a high ltv and not due to the ccj0 -

There's a register that is accessible. All information is kept on public record. Not just CCJ's either. CSA, fines etc. Lenders know more about potential borrowers than they realise.

Not a question of morality. Its lying and a fraudelent declaration. A way of being registered on the NationalHunters database if a lender feels so inclined. .0 -

You may be right but how often is this used? I know people who with poor credit history one file and not on the other and yet they got accepted for credit cards, bank accounts and mortgages.
This is one of many threads on this forum where people with poor credit history have posted that they have sucessfully obtained credit
