O2 Blackberry bought through Phones4U faulty.

Hi,

I have a Blackberry 9300 Curve (15 months old) which has been playing up recently, and finally gave up the ghost last night. It now won't switch on at all and just shows a red light constantly. It has had no abuse nor has it been water damaged.

I saw a post on an O2 forum which stated that the Blackberry warranty was 2 years, but I can't find any reference to this online.

Has anyone had a similar problem they got resolved, and if so, how?

Go into P4U and tell them whats happened. Tell them because you bought the contract through them any phonecalls you need to make if they can kindly let you do this instore with their help.

Make them work for it. They might even sort it out for you and save you the trouble.

Ask your phone operator first about whether they can fix it for free. If not ask them to give you the details of the BB repair centre so you can book your phone for a fix.

Otherwise you can get this number online also if you search.

    Why online?
    What does your paperwork say?
Apparently it's 12 months (http://uk.blackberry.com/legal/handheld_warranty.jsp ), but I've heard that it can depend on the model.

After 6 months they are most likely just to fob him off.

The operator has nothing to do with the handset, but they can advise where to repair it.

If the warranty is 12 months the only way to get it repaired for free is to sue p4u: Sale of Goods act vs Vodafone

They are likely to fob em off. But there is no harm in trying.
On my network, my operator arranges pick up and delivery for my phones if they need repairing or are faulty while im in my contract. Hence why i mention this. Again, no harm in trying. I gave other options if that didnt work.

Your advice was rather helpful about the Sales of Goods Act. Thanks for that.

Be careful with P4U. My blackberry had a keypad fault and I took it in to get fixed 2 weeks before my warranty ran out. They kept the phone two weeks apparently fixing it but when I got it back it had the same problems still.
However, on an old Blackberry I had with o2 they were really good with repairs and just replaced the handset rather than having me wait ages for it repairing.

this is from the adviceguide.org.uk site

    Replacement or repair

If you bought the phone on or after 31 March 2003, you can ask the seller to replace or repair it free of charge if it is faulty. If you do this within six months of receiving the phone, it will be assumed that the problem existed when you bought it, unless the seller can show otherwise. However, you can still ask for a replacement or a repair for up to six years from the date that you bought the phone, if it is reasonable for it to have lasted that long. In this case it will be up to you to show that the phone was faulty at the time of sale. The longer you have had the phone, the more difficult it becomes to prove that it was faulty at the time of sale.

    If

    :

it is impossible to replace or repair the phone; or

a replacement or repair would be unreasonably costly for the seller when compared with alternative remedies; or

the seller fails to replace or repair the phone within a reasonable time of having agreed to do so or causes you significant inconvenience; or

the phone has worked for some time before it goes wrong or only one of its functions has gone wrong

      then:

you can ask for a partial or full refund. The amount of money you get back may be reduced to take account of any use that you have had out of the phone.

If you go to http://uk.blackberry.com/update/ and use the online updater it should reinstall your software which will resolve your issues.
