can I claim a refund?

Three weeks ago I bought a 6 months old car from a franchised dealer...The car is fantastic and full of options which I am finding how to use as I go along(I hate reading manuals). One of the options is voice command to control the Satnav, tel., radio..etc and I Just discovered that it is not working. I thought it was faulty but when I searched on google I discovered that on the version of car I have (convertible) this option is factory disabled...I was assured , when I bought the car that it has the voice command. I phoned the dealer and they were surprised that voice command is not working and they booked the car for a check...They did not seem to know that it could be factory disabled and i did not want to tell them. Now if after they check the car they say it is factory disabled can I claim some refund as surly the presence of this option was incorporated in the car price?

  • i suppose you would be entitled to difference between the models without voice act satnav but HAS ALL OTHER FEATURES and what you paid.

    you may well get a good will of a free service.

    but you have to aske the question, my car doesnt have this feature that i was mislead to belive had it whats the difference in cost between this car here wich has everything that my car has minus voice act satnav, and refund me the difference or have it back as not described and refund the lot.

    Well technically yes the car is not as advertised, so you could ask for your money back and walk away from the deal. By which I mean literally walk away, unless you get someone to give you a lift home.


    Not sure how a voice activated satnav going to work in a convertible anyway, as soon as the roof goes down it's going to work about as well as a Glaswegian with an iPhone.

    yes..according to threads I found on google, the factory disable this feature on convertible cars but they should not put the button for voice command on the steering wheel as this is misleading. Also the voice command can be used perfectly when the roof is up..my point is when I had the test drive, the salesman was trying to show me how good is the car and he definitly said it had voice command.
  • My car was advertised as having electric seats. I bought it, and found that only the height and lumbar support are electrically adjustable, and not forward/back, tilt, or headrest. I was not bothered.

    By the way I had a motability car which had a voice control button on the steering wheel, however it did not have the voice control feature as this was only fitted to the models which had the navigation system which mine did not. They just use the same steering wheel in all of them as it's cheaper and easier. Incidentally the voice control button just operated the stereo mute.

    If they put the button there, the salesman probably also thought it had voice recognition. That's pretty shoddy.

    It's rare I'll say this about a car salesman, but I doubt he was deliberately trying to mislead you on this issue.

    What car is this anyway?

    it is an Audi..I also do not think that he knew about it being disabled (the guys at the service dep. did not know) but do you think if there was a £10 missing from my payment they will just say do not worry..it is on us!!! why should I accept an option less when I paid through the nose for the full Monty

    From what you have described, you have gotten the highest spec actually available for that vehicle in convertible form. Yes the dealership screwed up and you are in your rights to reject the deal, and they may well offer you something else as goodwill, such as a discount or some free servicing.

    Or, for all you know, they might find a way to re-enable the voice navigation with a software update, which will be fine so long as you keep the roof up.

    How many cars do you buy? You seem to be buying one every 6 months or so, the last was a BMW 635.

    I never said that I bought BMW, although I was interested in that model (635)...and please do not feel sorry for the dealer..they make a healthy profits and that is why I pay extra for them so if I am not happy they have to sort it out...I never buy cars privately
