So anyone in a similar situation cannot rely on no stat demand as a defence.
I've heard/seen similar things regarding the process servers used by Lowells. i.e. statements to the court that the defendant are damn sure are untrue; but of course that in most cases is next to impossible to prove.Stresshead1968 wrote: »Lowell continued to take me to court despite me disputing the debt back in August. Now the court case is over I am mindful to fire off complaints about these scumbags. Any suggestions? They should have their license revoked.
OFT are the current authority with the power to revoke their consumer credit license. Believe me, they have a very thick file on Lowells already.

It seems lowell buy debt on mass and bankrupt people without gathering proper evidence expecting most to pay up out of fear. It's scandalous.
Thanks you for sharing. It will help many people hopefully.
Sorry about the confusion.I misunderstood, and you were stressed when posting. Not great for clarity.
I would just say though, that for anyone else reading, please explain a bit more when first posting. Not a dig at you, as it happens all over the forum. I see so many posts threads that just basically say help with this or that without explaining or background, and it makes it difficult to respond in any meaningful or relevant way.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Unlikely, as despite some aberrations, unless you have significant equity in property etc then very few creditors will try this on. You can never say never, but you you basically have to be very unlucky.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Is the concept of 'unsecured' debt a misnomer these days?
Seeing as a creditor can have their 'unsecured' debt charged to the debtor's property, and ultimately can have a debtor declared bankrupt for relatively piddling amounts to have their debt made good from BR assets, saying 'unsecured' seems like a big fat lie to me.
Once I'm AD, I'm never, ever going to borrow money again and help feed that disgusting debt monster.0 -
I wonder if its a case pre- 2010 they didn't have the right paperwork in most cases to actually take you to court and win?
But in 2010 debts being bought had contracts and terms and conditions supplied putting them in a stronger position. Then Another dip as people found new flaws in their paperwork/tactics.
Then another climb as they work around those issues?
Dipping again because it's costing too much?
Just me thinking out aloud. Maybe way off the mark?Censorship Reigns Supreme in Troll City...0
